As used in these subdivision regulations, words in the singular include the plural and those in the plural include the singular; the word "may" is permissive; the words "shall" and "will" are mandatory.
As used in this chapter, the following terms shall have the meanings indicated:
ALLEY
A minor public way, having a right-of-way width between property lines of 20 feet, for secondary service access to the back or side of properties otherwise abutting on a street.
BLOCK
An area bounded by existing or proposed streets. Property abutting on one side of a street, and lying between the two nearest intersecting or intercepting streets, or nearest intersecting or intercepting street and railroad right-of-way, or other definite physical or natural barrier.
BUILDING
Any structure, or part thereof, affixed to the land.
BUILDING OR SETBACK LINE
A line parallel to a street or alley between which line and the street right-of-way line no buildings or structure may project.
CITY
The City of Lower Burrell, Westmoreland County, Pennsylvania.
CLEAR SIGHT TRIANGLE
An area of unobstructed vision at street intersections defined by lines of sight between points at a given distance from the intersection of street center lines.
COMMISSION
The Lower Burrell Planning Commission.
COMPLETION GUARANTEE
A deposit of cash, bond, certified check or negotiable securities and an agreement to the effect that the subdivider will install required improvements.
CROSSWALK
A public right-of-way having a width of 10 feet or more within a block intended for pedestrian use and from which motor vehicles are excluded.
COUNTY
Westmoreland County, Pennsylvania.
CUL-DE-SAC
A dead-end street having a suitable turnaround.
DEVELOPMENT
The act, process or state of erecting all structures except farm dwellings and structures.
DRAINAGE RIGHT-OF-WAY
The lands required for the installation of stormwater sewers or drainage ditches, or required along a natural stream or watercourse for preserving the channel and providing for the flow of water therein to safeguard the public against flood damage.
DWELLING, MULTIFAMILY
A single structure intended for occupancy by two or more families, including row houses, apartment buildings and apartment-hotels.
DWELLING UNIT
A structure or part of a structure intended for occupancy by a single family.
EASEMENT
A grant by the owner of land for the use by others, including the public.
FILING, PLAT
A plat shall be deemed to be filed with the Planning Commission when it has been received and properly receipted by the Commission secretary. The secretary may refuse to receive a plat if the procedures under these Subdivision Regulations or Planning Act 247[1] have not been fully observed. The secretary shall transmit plats to the official bodies concerned.
IMPROVEMENTS, PUBLIC
Any or all of the following: grading, paving, curbs, gutters, sidewalks, water lines, sanitary and storm sewer lines and structures, drainage channels and structures, curb returns, sidewalk and driveway entrances within rights-of-way, guard rails, traffic signals and devices, retaining walls, sodding and planting.
LOT
A portion of a subdivision or other parcel of land intended as a unit for transfer or ownership or for development or both. In determining the area of a lot, no part of the right-of-way of a street, alley or crosswalk may be included.
LOT DEPTH
The average dimension between front and rear property lines and measured perpendicular to or along the radius of the street right-of-way line.
LOT WIDTH
The average dimension between side property lines and measured parallel to the street right-of-way line or tangent line.
OWNER
Any person or legal entity having a proprietary interest in the land to be subdivided but not including a mortgagee, lienor, lessee or contract purchaser.
PERSON
An individual, corporation, unincorporated association, firm or partnership.
PLAT, FINAL
The final map of the subdivision which is filed for Planning Commission and Council approval and which, if approved, shall be filed with the County Recorder of Deeds.
PLAT, PRELIMINARY
A preliminary map indicating the proposed layout of the subdivision which is filed for Planning Commission consideration.
PUBLIC
Open to public use, whether or not public ownership is involved.
RESIDENTIAL AREA, HIGH-DENSITY
A tract of land in which there is an average of one or more dwelling units per 10,000 square feet of lot area.
RESIDENTIAL AREA, LOW-DENSITY
A tract of land in which there is an average of less than one dwelling per 10,000 square feet of lot area.
RIGHT-OF-WAY
Land reserved for use as a street, alley, crosswalk or other public purpose.
SIGHT DISTANCE
The maximum distance of unobstructed vision, in a horizontal or vertical plane, along a street from a vehicle located at any given point on the street which shall take into account the visibility over a crest vertical curve and the extent of headlight illumination across a sag vertical curve.
STREET
A right-of-way which affords the principal means of access to the abutting property. "Street" may be used for pedestrian and vehicular traffic, and may be so designated as a highway, thoroughfare, parkway, boulevard, road, avenue, lane, drive, place or other appropriate name so affixed.
MAJOR STREET
A street intended for large volumes of traffic.
MINOR STREET
A street intended primarily to provide access to abutting residential properties. Certain minor streets may be culs-de-sac.
WATERCOURSE
A channel, creek, ditch, drain, dry run, spring or stream.
THOROUGHFARE PLAN
The part of the Master Plan, now adopted, which sets forth the general location, alignment and dimensions, and the identification, and classification of existing and proposed public streets, highways and other thoroughfares.
SUBDIVIDER
Any person who undertakes the subdivision of land as defined below. The subdivider may be the owner of the authorized agent of the owner of the land to be subdivided.
SUBDIVISION
The division of a single lot, tract or parcel of land into three or more lots, including all changes in street or lot lines for the purpose, whether immediate or future, of transfer of ownership or for building development. "Subdivision" also includes resubdivision of land, whether by lots or by metes and bounds.
