This article hereby creates and establishes the Office of the
Village Attorney.
At each regular meeting in January of each year, the Village
President shall nominate and the Village Council, by way of a majority
vote, shall appoint, consistent with MCLA § 62.2, a Village
Attorney for the Office of the Village Attorney.
A.
The Village Attorney shall serve the Village Council and shall act,
at all times, as legal counsel to the Village Council. The Village
Attorney shall be the legal advisor of the Council and of the elected
and otherwise appointed officers and boards of the Village. The Village
Attorney shall act as the attorney for the Village as requested and
in all legal matters in which the Village is interested and shall
prosecute all offenses against the ordinances of the Village. The
Village Attorney shall timely keep the Village Council advised on
all legal projects including research and pending litigation. Copies
of all attorney work product shall be made available to the Village
Council as attorney-client privileged documents. Any litigation against
the Village or its designees shall be immediately analyzed for insurance
coverage.

The compensation set by the Council for the Village Attorney shall
be in contemplation of the normal duties of that office. Special compensation
may be provided at the discretion of the Council for services rendered
by the Village Attorney in proceedings before quasi-judicial or administrative
tribunals and before any court, including but not limited to any appellate
court, other than one whose jurisdiction is confined to the Village.
Upon the recommendation of the Village Attorney, or upon its own initiative,
the Council may retain special legal (counsel) to handle any matter
in which the Village has an interest or to assist and counsel the
Village Attorney or to carry out the objectives of the Village Council.
