A. 
The Council of the City of Latrobe does hereby prohibit the use of engine brake retarders (Jake brakes®) on the following highways located within the limits of the City of Latrobe:
(1) 
State Route 0981: Lloyd Avenue.
(2) 
State Route 0981: Depot Street.
(3) 
State Route 0981: Main Street.
(4) 
Lincoln Avenue (City road).
(5) 
Ligonier Street (City road).
B. 
All City-owned (or leased) vehicles are hereby exempted from the prohibition upon use of engine brake retarders set forth in § 196-1A above.
The violation of and noncompliance with this chapter shall result in a citation issued by the Police Department of the City. The operator of said vehicle shall be subject to a penalty/fine of $50 for the first violation plus cost of prosecution. A subsequent citation against the same operator for the same violation occurring within a two-year period after a previous violation shall result in a penalty/fine of $100 for said violation. Failure to pay any fine or cost levied by the District Justice within 30 days after conviction or expiration of the time limit to appeal said citation may result in the incarceration of the operator for a period not to exceed five days. Such fine and costs may be collected by any remedy available to the City under law.
The Mayor, City Manager, City Secretary and any other proper City Officer be and are hereby authorized and directed to sign any and all documents and to take any and all action necessary, including but not limited to the placement of appropriate signage, to carry into effect this provisions of this chapter.
The within chapter shall become effective July 1, 2013.
