It is hereby the intent of this Chapter to regulate the operation of lodging establishments as defined herein is a business affecting the public health, safety and general welfare.

For the purposes of this Chapter, the following terms, phrases and words shall have the meanings herein expressed:
BED AND BREAKFAST
An existing building(s) with no more than three (3) occupiable stories, with at least five (5) but no more than ten (10) guest rooms. The building shall have interior corridors and be provided with a kitchen; breakfast shall be provided to guests and the owner must live in or adjacent to the building.
CODE
The standards relating to fire safety, sanitation, electrical wiring, fuel-burning appliances, plumbing, swimming pools and spas, sewage and waste treatment and disposal as current adopted code by the City of Hollister.
GUEST ROOM
Any room or unit where sleeping accommodations are regularly furnished to the public.
LODGING ESTABLISHMENT
Any building, group of buildings, structures, facility, place, or places of business where five (5) or more guest rooms are provided, which is owned, maintained, or operated by any person and which is kept, used, maintained, advertised or held out to the public for hire which can be construed to be a hotel, motel, motor hotel, apartment hotel, tourist court, resort, cabins, bunkhouse, dormitory, time share (five (5) or more owned or managed privately or commercially), or other similar place by whatever name called, and includes all such accommodations operated for hire as lodging establishments for either transient guests, permanent guests, or for both transient and permanent guests. This definition shall not apply to dormitories and other living or sleeping facilities owned or maintained by public or private schools, colleges, universities, or churches unless made available to the general public and not used exclusively for students and faculty, school or church sponsored events.
OWNER
The person responsible for obtaining a license from the City Clerk for operating a lodging establishment.
PERMANENT GUEST
Any person who occupies a guest room in a lodging establishment for a period of thirty-one (31) days or more which include nightly, weekly and/or monthly rentals. This includes all extended stays and does not exclude any lodging establishment from meeting the requirements of this Chapter (generally referring to in-house staffing).
PERSON
Any individual, firm, corporation, owner or operator of a lodging establishment.
TRANSIENT GUEST
Any person who rents and occupies a guest room in a lodging establishment for any length of time which could include nightly, weekly, and/or monthly rentals in which the period of time does not exceed thirty-one (31) days.

It shall be unlawful for any person, firm, or corporation owning, controlling, or leasing, acting as agent for conducting, managing or operating any lodging establishment without first applying for and receiving a City license from the City Clerk.

A. 
Application. Any person desiring a lodging establishment health permit shall make written application for a permit on forms provided by the City Clerk.
B. 
Issuance. After receipt of an application for a lodging establishment health permit, the Health Department shall inspect the proposed lodging establishment to determine compliance with the provisions of this Chapter and the Missouri Department of Health and Senior Services under Sections 315.005 — 315.065. If applicable requirements have been met, the Health Department shall issue a lodging establishment health permit

A. 
The annual permit fee for lodging establishment shall be based on assessed risk priority and inspection frequency.
B.

Licenses and permits for a lodging establishment under the provisions of this Chapter may be granted at any time during the year, but all licenses and permits issued herein under shall expire on the 30th day of June. Licenses shall not be transferable from one (1) person to another or from one (1) location to another.

All licenses and permits shall be posted at all times in a visible location in the establishment.

Every lodging establishment, and every part thereof, shall be required by or in accordance with any regulation of Missouri Department of Health and Senior Services (19 CSR 20-3.050) or order of the Health Department.

Any person, firm or corporation who shall operate a lodging establishment in this City, or who shall let a building used for such business without having first complied with the provisions of this Chapter or who violates any of the provisions of same shall be guilty of a misdemeanor and upon conviction thereof be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each such violation. Each and every day of such non-compliance shall constitute a separate violation.
