There is hereby established a fund for the preservation, care, upkeep and adornment of the City owned cemetery which fund shall be known as the Perpetual Care Cemetery Fund.

The City of Willow Springs, Missouri, may accept and acquire any gift or donation of money or funds to be placed to the credit of such Perpetual Care Cemetery Fund.

There shall be deposited in the said Perpetual Care Cemetery Fund the sum of one hundred dollars ($100.00) of the gross sale price on the sale of five (5) grave space lots and the sum of twenty-five dollars ($25.00) for each single space grave lot sold in the City-owned cemetery.

Such monies and funds so placed in such Perpetual Care Cemetery Fund shall be invested from time to time in bonds of the United States Government and of the State of Missouri or of municipal bonds or savings and time certificates in any bank chartered by the Federal or State Governments, which deposits are insured by F.D.I.C.; and the income therefrom shall be expended by the City of Willow Springs, Missouri, for the preservation, care, upkeep and adornment of the City-owned cemetery for the repurchasing of cemetery lots previously sold and for no other purposes whatsoever.

The principal of said Perpetual Care Cemetery Fund shall not be encroached upon for any purpose whatsoever and no money shall be transferred out of such Perpetual Care Cemetery Fund except for the purpose of being invested as herein provided for.

The Mayor and Board of Aldermen of the City of Willow Springs, Missouri, shall by ordinance accept any gift or donation to the said Perpetual Care Cemetery Fund and shall by ordinance direct the Treasurer of the City to place any money or funds to the credit of the Perpetual Care Cemetery Fund of the City of Willow Springs, Missouri, to be invested as in this Chapter provided for.

All installations and erections of grave markers any place within the cemetery of the City of Willow Springs shall be under the direction and supervision of the sexton or other person or persons designated by the Mayor and Board of Aldermen and shall not interfere with the maintenance of the cemetery.

A. 
The cemetery reserves the right to remove all flowers, potted plants, summer wreaths or baskets of flowers when they become withered or for any other reason and the supervisor is ordered to make such removals when in his/her judgment it is in the best interests of the cemetery.
B. 
No wall, curbing, shrubbery or growing plants, or any other type of enclosure or addition shall be located or planted in any place or location in the City cemetery, unless it first be approved by the Mayor and the Board of Aldermen. Any items placed in violation of this Section shall be removed.
C. 
Any items that interfere with the maintenance of the cemetery shall be removed in accordance with this Section.

All headstones or monuments shall be placed on solid ground at the head of the graves and shall have a foundation of good concrete that is a minimum of fifteen (15) inches in depth and there shall be a flange that extends beyond the base six (6) inches and the flange must be constructed flush with the ground. The flange shall be a minimum of six (6) inches in depth and shall be finished in a workmanship like manner. All footstones shall have a four (4) inch flange and shall be set at ground level or according to the direction of the sexton. Maximum width for all headstones and monuments shall be three (3) feet for a single grave and six (6) feet for a double grave. No other permanent markers of any kind shall be placed on or near graves. The City of Willow Springs distinctly disclaims all responsibility for loss or damage from causes beyond its control, including, but not limited to, damage caused by the elements, an act of God, theft, vandalism, explosions and unavoidable accidents.

All persons desiring to erect or install grave markers any place within said cemetery shall follow the provisions of this Chapter or be subject to a penalty as herein provided.

A concrete or metal burial vault for the purpose of placing a casket therein shall be used in all interments and the grave shall be of such a depth that the top of the vault is at least eighteen (18) inches below the top of the ground.

A. 
The price for a single grave space shall be two hundred fifty dollars ($250.00). The cost of recording fees shall be thirty-five dollars ($35.00) for two (2) pages.
B. 
The cost of opening a grave Monday through Friday, including administration fees, shall be the sum of five hundred dollars ($500.00). The cost of opening a grave on holidays and weekends, including administration fees, shall be the sum of six hundred dollars ($600.00). The cost of opening a grave for cremation Monday through Friday, including administration fees, shall be the sum of two hundred dollars ($200.00) unless machinery is used at which time the cost will then be three hundred dollars ($300.00). The cost of opening a grave for cremation on holidays or weekends, including administration fees, shall be the sum of three hundred dollars ($300.00), unless machinery is used, at which time the cost will then be four hundred dollars ($400.00).
C. 
The City may re-purchase cemetery plots at a discounted rate of thirty percent (30%) below the then-current sales price, as set by the Board of Aldermen, with proof of proper ownership.
