As used in this article, terms are defined as follows:
UNENCLOSED
Any front, side or back porch, patio, deck or balcony that is not closed in to shield it year round from the elements.
UPHOLSTERED FURNITURE
Any furniture that contains attached filling material, stuffing or cushions or springs, and is used or intended to be used for sitting, reclining or resting not intended for outdoors, which includes but is not limited to places that are exposed to precipitation, such as yards, rooftops, enclosed porches, decks, patios and balconies.
The use, keeping or storage of any upholstered furniture manufactured primarily for indoor use, including but not limited to mattresses and box springs, sofas and chairs, shall be prohibited on any front, back or side yard or patio visible from any public or private place, sidewalk or highway.
The use, keeping or storage of any upholstered furniture manufactured primarily for indoor use, including but not limited to mattresses and box springs, sofas and chairs, shall be prohibited on any front, back or side unenclosed porch, deck or balcony visible from any public or private place, sidewalk or highway.
No person shall place, use, keep, store or maintain outdoors of any premises any indoor upholstered furniture not manufactured for outdoor use, including but not limited to upholstered chairs and couches, except when said indoor upholstered furniture is placed at the curb on the customary collection day for it to be removed as part of the large item waste removal service, or when said indoor upholstered furniture is placed outdoors as part of a garage sale.
Any person violating this article shall be fined a minimum of $200 and a maximum of up to $500 plus court costs. Each day the condition continues shall constitute a separate offense.
