The following words, when used in this chapter, shall, for the
purposes of this chapter, have the meanings respectively ascribed
to them in this section:
The Borough of Moosic.
The form furnished by the Borough of Moosic to the licensee
for the purpose of the recording and furnishing by the licensee to
the Borough of Moosic of the required information relative to purchases,
pledges or consignments.
The designated Code Enforcement Officer of the Borough.
Any type of store in which goods of other individuals are
sold, and the owner of the store receives a percentage from the sale
of goods.
Person having any ownership interest in the premises.
Refers to any natural person, any partnership, any corporation
and/or association.
A.Â
Every owner
of a consignment store, whether used solely as a consignment store
or as part of another business, is required to obtain of license prior
to his/her selling or holding consigned goods.
B.Â
The Secretary
of the Borough shall provide an appropriate application form for obtaining
the license, and such license shall be required on a yearly basis.
C.Â
An owner
operating a consignment store shall be required to have a license
prior to receiving any consigned merchandise.
D.Â
No person
shall sell any consigned goods within the Borough without a license.
E.Â
The Borough
shall set the license fee by resolution and such shall be paid in
order to obtain a license.
A.Â
Every licensee
shall, and it is hereby made the duty of the licensee to, obtain from
the Chief of Police and to fill out and complete, in quadruplicate,
an appropriate buy-form covering each day's transactions. Within three
hours after the close of business of any business day, each such licensee
shall mail or deliver to the Chief of Police the original buy-form,
together with two duplicate copies thereof, covering the business
transacted on that day.

The buy-forms
shall contain a full, true and complete report of all goods, wares
and merchandise or things received on deposit, consigned, pledged
or purchased during the day covered by such forms, and shall also
contain the type of business of the licensee, and may assist in the
detection of stolen property. Every licensee shall enter upon the
buy-form positive identification furnished by the seller, pledge maker
and consignor, such as driver's license number, work badge number,
auto or truck license number and junk collector's business license
number, in addition to the true name and address of the seller, pledge
maker or consignor. In lieu of the positive identification mentioned
above, the licensee shall require the seller, pledge maker or consignor
to furnish a plain impression print of his/her right index finger
upon the face side of the original sheet of the buy-form.
If any consigned goods are stored outside, then the area where
said goods are stored shall be screened by a solid fence so said goods
are not visible from off the premises where the goods are sold. Any
fencing shall be solid and constructed in accordance with Borough
ordinances.
Any person who violates or permits a violation of this chapter,
upon being convicted before a District Justice, shall pay a fine not
exceeding $600 and any costs incurred by the Borough of Moosic. Each
day of the violation shall be considered a separate violation and
offense.
