Every operator of a vehicle approaching an intersection at which an official traffic control device is erected in accordance with this chapter shall obey the direction of such official traffic control device as required by the Wisconsin Statutes incorporated by reference in § 392-1 of this chapter. Operators of vehicles approaching a stop sign shall stop before entering a highway as required by § 346.46, Wis. Stats. Operators approaching intersections at which a yield sign has been installed shall yield the right-of-way to other vehicles as required by § 346.18(6), Wis. Stats.

A. 
The highways set forth on the attached Exhibit A[1] are hereby designated as Class "B" Highways, and, accordingly, all highways listed on the attached Exhibit A are subject to the weight limits set forth in § 348.16(2), Wis. Stats.

B. 
No person may operate any vehicle or combination of vehicles on the highways listed on the attached Exhibit A in violation of the weight limits set forth in § 348.16(2), Wis. Stats. Any violation shall be subject to penalties under § 348.21, Wis. Stats., together with the costs of prosecution, including reasonable attorneys' fees to the extent permitted under Wisconsin law. Motorized and nonmotorized farm/agricultural vehicles and vehicles operated for transporting livestock, with gross combined weights of vehicle plus contents not exceeding 92,000 pounds, are exempt from the permit requirements of this section; however, such vehicles with contents having combined weights exceeding 92,000 pounds are subject to permit requirements under County ordinances and County permits with approval by the Town Chairman prior to using Town roads for such vehicles, all due to the agribusiness nature of the Town of Vinland.
C. 
Signage. To the extent required by law, the Town of Vinland shall place appropriate signs on the highways listed on the attached Exhibit A on or before the effective date of this section.
D. 
Permits/administration.
(1) 
The Town of Vinland shall have the authority and discretion to issue permits on a case-by-case basis to certain individuals and/or entities for the operation of a vehicle (or vehicles) upon a highway (or highways) listed on the attached Exhibit A otherwise in violation of the weight limits set forth in § 348.16(2), Wis. Stats. The Town Chairman shall be responsible for administering the permit process, and the Town Chairman and any Town Supervisor shall have the authority and discretion to issue permits without the need to obtain Town Board approval.
(2) 
The process to obtain a permit is as follows:
(a) 
Permits must be requested, in writing, by the owner/operator of the vehicle(s) to be operated at least 48 hours in advance of the day and time of operation.
(b) 
The request must contain the following information:
[1] 
Description of vehicle(s) to be operated.
[2] 
Owner of the vehicle(s) to be operated.
[3] 
Operator of the vehicle(s) to be operated.
[4] 
Description of what is being hauled (i.e., material, equipment, etc.).
[5] 
Number of loads/trips.
[6] 
Average weight of each load as distributed by axle.
[7] 
Route (from beginning to destination).
[8] 
Average speed.
[9] 
Dates and times of travel.
(c) 
A separate permit must be issued for each vehicle to be operated, and the permit needs to be available at all times in each vehicle while operated.
(d) 
The Town of Vinland may place any restrictions/conditions on the permit as the Town of Vinland deems necessary and appropriate.
(3) 
Notwithstanding anything contained in this Subsection D to the contrary, even if a permit is issued for the operation of a vehicle (or vehicles) upon a highway (or highways) listed on the attached Exhibit A in. violation of the weight limits set forth in § 348.16(2), Wis. Stats., the owner and operator of said vehicle (or vehicles) shall be responsible and liable to the Town of Vinland as set forth and described in Subsection E below.
(4) 
Pre-permit filming and/or photography and post-permit filming and/or photography may be implemented/required by the Town of Vinland to document any damage to Town of Vinland highways, in addition to any other conditions imposed for a permit.
E. 
Damage to highway. In the event any person and/or entity violates this section and such violation causes damage to any highway located within the Town of Vinland, any such violating person and/or entity shall be solely responsible and liable to the Town of Vinland for any and all costs incurred by the Town of Vinland in repairing such damage, together with the costs of collection, including reasonable attorneys' fees to the extent permitted under Wisconsin law.
F. 
Enforcement. In addition to all other rights and remedies available at law or in equity, this section may be enforced by the Town of Vinland against any violator either in Municipal Court for fines and forfeitures. and/or the Circuit Court for Winnebago County for fines, forfeitures, and/or injunctive relief. This section may be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin. This section may be enforced by the issuance of citations for enforcement in Municipal Court by the Town Chairman, any Supervisor, or the Town Supervisor. or by the filing of civil action in Circuit Court by the Town of Vinland's attorneys.

General provision. The provisions of §§ 346.57, 346.58 and 346.59, Wis. Stats., relating to the maximum and minimum speed of vehicles, are hereby adopted as part of this section as if fully set forth herein, except as hereinafter specified pursuant to § 349.11(3)(c), Wis. Stats.
B. 
Speed limits - 25 mph. A traffic and engineering investigation having been made on the following described highway; the maximum permissible speed at which vehicles may be operated on said highway, which speed is herewith established as reasonable and safe pursuant to § 349.11, Wis. Stats., shall be set forth herein, subject to approval by the Department of Transportation and upon the erection of standard signs giving notice thereof:
(1) 
Cowling Bay Road, County Highway A east, for a distance of 0.74 mile, Town of Vinland, Winnebago County, shall be 25 miles per hour for all vehicles.
C. 
Speed limits - 30 mph. A traffic and engineering investigation having been made on the following described highway, the maximum permissible speed at which vehicles may be operated on said highway, which speed is herewith established as reasonable and safe pursuant to § 349.11, Wis. Stats., shall be set forth herein, subject to approval by the Department of Transportation and upon the erection of standard signs giving notice thereof:
(1) 
Paynes Point Road, Town of Vinland, Winnebago County, shall be 30 miles per hour for all vehicles.
D. 
Speed limits - 40 mph. A traffic and engineering investigation having been made on the following described highway, the maximum permissible speed at which vehicle may be operated on said highway, which speed is herewith established as reasonable and safe pursuant to § 349.11 Wis. State Stats., shall be set forth herein, subject to approval by the Department of Transportation and upon the erection of standard signs giving notices thereof;

E. 
Speed limits - 45 mph. A traffic and engineering investigation having been made on the following described highways, the maximum permissible speed at which vehicles may be operated on said highway, which speed is herewith established as reasonable and safe pursuant to § 349.11, Wis. Stats., shall be set forth herein, subject to approval by the Department of Transportation and upon erection of standard signs giving notice thereof;
(1) 
Grimson Road, Town of Vinland, Winnebago County: 45 miles per hour for all vehicles from the Vinland-Winneconne Town Line east to Hilltop Road.
(2) 
Vinland Center Road, from County Road T east to State Highway 76, Town of Vinland, Winnebago County, shall be 45 miles per hour for all vehicles.
(3) 
Indian Point Road, portions in the Town of Vinland and in the Town of Oshkosh. (This subsection was adopted in cooperation and jointly between both Towns.)
(4) 
Kolb Road, Town of Vinland, Winnebago County, shall be 45 miles per hour for all vehicles.
(5) 
Skeleton Bridge Road, Town of Vinland, Winnebago County, shall be 45 miles per hour for all vehicles.
(6) 
Dixie Road from Vinland Town Line on the north to County Road GG on the South; also, Green Valley Road south from County Road GG to State Highway 76: reduced to 45 miles per hour for all vehicular traffic.

Sherman Road from County Road GG south to Indian Point Road.

A. 
An Official Road Map of the Town of Vinland is hereby established. The map shall be the Official Road Map for the Town of Vinland.
B. 
Said Official Road Map shall designate the streets, highways, location of railroad rights-of-way and recreational trails which may exist in the Town.
