It shall be unlawful for any person, firm or corporation to
place any sludge on any land in the Town of Vinland, Winnebago County,
Wisconsin, whether digested sludge or raw sludge, whether from a private
domestic treatment plant or from a municipal sewage system or sewage
treatment plant, from outside the Town of Vinland; provided, however,
that no person shall under this chapter be prohibited from dumping
sludge on his/her own premises which is produced on said premises;
and further provided that no person shall, under this chapter, be
prohibited from dumping sludge on his/her own premises, which premises
have been approved by the Wisconsin Department of Natural Resources
as a licensed solid waste disposal facility and which are subject
of a negotiated agreement under § 289.33(9), Wis. Stats.,
between said person and the Town of Vinland.
Each and every day that sludge is disposed of in the Town of
Vinland, Wisconsin, in violation of the previous section of this chapter
constitutes a separate offense.
A.
Any person, firm or corporation, violating of the provisions of this chapter shall, upon conviction thereof, be subject to § 1-4, General penalty, of the Code.
B.
In addition to the penalties provided by this section, the Town of
Vinland, Winnebago County, Wisconsin, will have the right to obtain
an injunction against any violation of this chapter.
