A. 
The Village of Webster, Burnett County, Wisconsin, adopts the following ordinance for the operation of all-terrain vehicles and utility terrain vehicles upon the roadways listed in § 249-3.
B. 
Following due consideration of the recreational value to connect trail opportunities and weighted against possible dangers, public health, liability aspects, terrain involved, traffic density and history of automobile traffic, this chapter has been created.
A. 
This route is created pursuant to Village authority as authorized by § 23.33(8)(b), Wis. Stats.
B. 
The applicable provisions of § 23.33, Wis. Stats., and regulating ATV/UTV operation pursuant to routes are adopted.
A. 
Road(s) to be open for ATV/UTV routes are as follows:
(1) 
West Alder Street.
(2) 
Sturgeon Avenue North.
(3) 
Sturgeon Avenue South.
(4) 
Muskey Avenue South.
(5) 
East Fir Street.
(6) 
West Fir Street.
(7) 
East Poplar Street.
(8) 
West Poplar Street.
(9) 
Oak Street East.
(10) 
Sears Street.
(11) 
Alleys.
B. 
Road(s) not open for ATV/UTV routes are as follows:
(1) 
Main Street East and West.
(2) 
County Road X.
(3) 
County Road FF.
(4) 
State Highway 35.
As a condition for the use of this route, the following conditions shall apply to all operators, and passengers:
A. 
No person under the age of 16 years may operate an ATV/UTV on specified Village ATV/UTV routes.
B. 
All ATV/UTV operators shall operate at no more than 10 mph.
C. 
All ATV/UTV operators shall ride single file on the extreme right side of roadways.
D. 
All ATV/UTV operators shall only ride on paved surface of roadways.
E. 
All ATV/UTV operators must have operating brake lights and turn signal lights. If these are not in operating order, use of hand signals are mandatory.
F. 
All ATV/UTV operators shall slow the vehicle to 10 mph or less when operating within 150 feet of a dwelling.
G. 
All ATV/UTV operators shall slow the vehicle to 10 mph or less when operating within 100 feet of a nonmotorized vehicle.
H. 
All ATVs/UTVs will have current registration stickers present on both sides.
I. 
Routes must be signed in accordance with § NR 64.12, and § NR 64.12(7)c.
J. 
Routes will be open for public ATV/UTV usage daily during the following time periods: 2:30 a.m. and 7:00 a.m.
This chapter shall be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.
Wisconsin state all-terrain vehicle/utility terrain vehicles penalties as found in § 23.33(13)(a), Wis. Stats., are adopted by reference.
The provisions of this chapter shall be deemed severable, and it is expressly declared that the county and Village would have passed the other provisions of this chapter irrespective of whether or not one or more provisions may be declared invalid. If any provision of this chapter or the application to any person or circumstances is held invalid, the remainder of the chapter and the application of such provisions to other persons circumstances shall not be deemed affected.
This chapter becomes effective on publication and posting. The Village Clerk shall properly publish or post this chapter as required under § 60.80, Wis. Stats.
