This Part shall be known as the "Animal Ordinance of the Township
of North Fayette." North Fayette Ord. 42, enacted May 5, 1960, and
North Fayette Ord. 72, enacted June 15, 1964, are hereafter incorporated
in their entirety into this Part.

The purpose of this Part is to protect the health, safety and
welfare of the people of the Township as pertains to nuisances and/or
problems from domestic or wild animals.

1.
It shall be unlawful for the owner or keeper of any dog or other
animal to fail to at all times keep such animal either:
A.
Confined within the premises of the owner.
B.
Firmly secured by means of a collar and chain or other device so
that the animal cannot stray beyond the premises on which it is secured.
C.
Remain at all times under the reasonable control of some person.
D.
Except that, the animal may run free when engaged in lawful hunting,
exhibition or field hunting.

No person, whether owner, keeper, or person in charge, control or
possession of any dog or animal, shall permit the dog or animal to
run at large upon any public street, or upon the outdoor area of any
public or private property in North Fayette Township.

Any dog or other animal that may engage in continual barking
or loud noise for a period of at least 15 minutes to the extent that
same may disturb the quiet of a neighborhood, shall be confined within
a relatively soundproof building with closed doors and windows so
that any barking will not annoy, disturb, injure, or endanger the
comfort, repose, peace, or safety of any individual. Provided, however,
for purposes of this section, an exception is granted for a dog, if
at the time the dog is barking or making any other noise, a person
is trespassing or threatening to trespass upon private property in
or upon the property upon which the dog is situated or for any other
legitimate cause which teased or provoked the dog.

It shall be unlawful for any person owning, keeping or walking
any dog to permit his or her dog, to discharge such animal's
excreta upon any public or private property within North Fayette Township,
other than the property of the owner of such dog, if such person does
not immediately thereafter remove and clean-up such animal's
excreta from the public or private property.

No person, firm or corporation shall keep or maintain a wild
cat, as defined below, within the Township of North Fayette. Examples
of such wild cats include, but are not limited to, the following:
cheetah, leopard, jaguar, tiger, lynx, bay cat, leopard cat, bobcat,
mountain cat, ocelot, European wildcat, lion, puma, mountain lion,
jungle cat or any other type of wildcat.

No person, firm or corporation shall keep or maintain any type
of wild animal, including, but not limited to, the following: raccoon,
fox, weasel, skunk, scorpion, poisonous snake, alligator, crocodile
or reptile.

No person shall abandon any domestic animal or permit a domestic
animal in his or her custody to become a stray.

Any person who shall be advised by the Township Police Department
or Animal Control Service and/or their designee of a violation of
this Part, shall immediately take all necessary actions to cause said
violation to cease and/or terminate after the first violation. Upon
a second or subsequent notice of violation within a six-month period,
the responsible person, upon conviction thereof in an action brought
before a magisterial district judge in the manner provided for the
enforcement of summary offenses under the Pennsylvania Rules of Criminal
Procedure, shall be sentenced to pay a fine of not less than $50 nor
more than $1,000 plus costs, including reasonable attorney fees incurred
by the Township in regards to the enforcement thereof. A second conviction
for a violation within a six-month period shall subject the person
who violates the same to a fine of not less than $100 nor more than
$1,000, plus costs, including reasonable attorney fees incurred by
the Township in regards to the enforcement thereof. A third conviction
for a violation within a six-month period shall subject the person
who violates the same to a fine of not less than $150 nor more than
$1,000, plus costs, including reasonable attorney fees incurred by
the Township in regards to the enforcement thereof. A fourth or further
conviction for a violation shall subject the person who violates the
same to a fine of not less than $200 nor more than $1,000, plus costs,
including reasonable attorney fees, incurred by the Township in regards
to the enforcement thereof and, in default of payment of said fine
and costs, to a term of imprisonment not to exceed 90 days. Each day
that a violation of this Part continues or each section of this Part
which shall be found to have been violated shall constitute a separate
offense.

The duty of administering and enforcing the provisions of this
Part is hereby conferred upon the Township Police Department, the
Animal Control Service or upon such other person designated by resolution
by the Board if Supervisors, provided such designee may not hold any
elective office in the Township.
