LIQUOR

As used in this Part, the following terms shall have the meanings
indicated:
Includes any alcoholic, spirituous, vinous, fermented or
other alcoholic beverage, or combination of liquors and mixed liquor
a part of which is spirituous, vinous, fermented or otherwise alcoholic,
including all drinks or drinkable liquids, preparations or mixtures
and reused, recovered or redistilled denatured alcohol usable or taxable
for beverage purposes which contain more than 0.5% of alcohol by volume,
except pure ethyl alcohol or malt brewed beverages.
Any beer, lager beer, ale, porter or similar fermented malt
beverage containing 0.5% or more of alcohol by volume, by whatever
name such beverage may be called.
Any beverage intended to be marketed or sold as non-alcoholic
beer, wine or liquor having some alcohol content but does not contain
more than 0.5% alcohol volume.
The location of any container, bottle or can containing liquor,
malt or brewed beverages, or non-alcoholic beverages which is nearby,
close at hand, convenient of access and within reach of the person.
The condition of a container whose cap, cork, top or other
closing device has been removed or the condition of a can which has
been punctured or pulled open so as to break its seal allowing consumption
of said beverages.
To exercise conscious dominion or control over.
Any public street, sidewalk, alley, walkway, park, road or
playground or any other public grounds owned by the Township of North
Fayette, also including any public grounds owned by the West Allegheny
School District.

No person shall have on or about his or her person, possess, carry
or transport liquor, wine, beer or other alcoholic beverages in open
containers in or upon any public place in the Township of North Fayette.

No person shall drink or consume liquor, wine, beer or other alcoholic
beverages in open containers in or upon any public place in the Township
of North Fayette.

The restrictions contained in this Part shall not apply to the consumption
or possession of any liquor, wine, beer or other alcoholic beverages
in or upon public places at specific times and in specific locations
and for specific purposes, such as for Township-sponsored celebrations
or similar events.

Individuals are prohibited from bringing their own liquor, wine,
beer or other alcoholic beverages in or upon public places in which
Township-sponsored celebrations or similar events are being held.
Only alcoholic beverages which the Township authorizes to be purchased
and supplied by the vendors at the aforementioned events are permitted.

It is the current practice of the Township to allow possession and
consumption of liquor, wine, beer and other alcoholic beverages at
groves and buildings where a permit has been issued by the Parks and
Recreation Department. Nothing contained in this Part shall be construed
as limiting or altering this current practice. However, the possession
and consumption of liquor, wine, beer and other alcoholic beverages
shall continue to be prohibited at any amenity or facility located
at any public place within the Township of North Fayette as defined
herein.

Where a permit has been issued allowing the possession and/or consumption
of liquor, wine, beer and other alcoholic beverages, all park rules
and regulations shall be complied with. Possession and/or consumption
shall be limited to the grove or building for which the permit was
issued and shall not be removed from said location. In the event any
individual violates this Part, becomes disorderly or breaks any laws,
the permit shall be revoked and penalties will be assessed.

Consistent with the current practice of the Township, any individual
or group renting a grove or building for any lawful purpose, and planning
to provide liquor, wine, beer and other alcoholic beverages to the
attendees, an alcohol beverage consumption permit, as issued by the
Township of North Fayette Parks and Recreation Department, shall be
obtained and all fees shall be paid at the time the grove or building
is rented.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.
