1. 
Towing services must verify their towing service place of business is located in the Township of North Fayette.
2. 
Towing services must provide proof of not less than $1,000,000 combined single limit insurance coverage and agree to maintain same at all times while participating as a towing services operator pursuant hereto. Proof must be in the form of a certificate of insurance.
3. 
Towing services must sign an agreement relieving the Township from any and all responsibilities from the time the towing services takes control of the vehicle(s) to be towed. (See Attachment 13-5-A).
4. 
Towing services must be on call and readily available 24 hours a day, seven days a week, during their specified month(s) of primary coverage. Tow operators may not refuse a call for service during their assigned month(s) without reasonable and just cause. The Township has sole discretion in determining what constitutes reasonable and just cause for refusing service.
5. 
Towing service is responsible for road debris clean up and vehicle parts for each incident. The debris and vehicle parts must be removed from the scene. If the clean-up does not satisfy the North Fayette Township Police Department, the towing service will be required to revisit the scene within one hour of notification from the Police Department to complete the cleanup.
6. 
A completed "Application for Towing Service in North Fayette Township" must be completed and signed by the Chief of Police before any towing service will be permitted to perform towing services for North Fayette Township. (See Attachment 13-5-B).

1. 
All towing services should have a minimum of the following equipment and submit to the Township Police Chief the required information:
A. 
At least one conventional wrecker with wheel lift capable of towing and/or full recovery of standard passenger cars and light trucks that comprise the vast majority of traffic on the highways in North Fayette Township.
B. 
At least one tilt bed or roll back track capable of hauling or towing standard passenger cars and light trucks that comprise the vast majority of traffic on the highways in North Fayette Township.
C. 
All equipment must be kept clean and in good working order.
D. 
All vehicles must carry a broom and shovel for clean up.
2. 
Towing service must submit a complete written listing of all towing equipment owned and available to the towing operator. The list should also identify vehicle capacity, limitations. Notification of all additions, deletions and/or alterations to the above equipment list must be made immediately to the Township Chief of Police when such equipment changes occur.
3. 
Towing service must submit in writing how many operators they have employed, years of experience and their capabilities. Any change in the number of operators must be immediately communicated in writing by the towing service to the Township Chief of Police.

1. 
The primary towing coverage for North Fayette Township will be assigned to a towing service on a monthly rotating schedule which will begin on the first day of that particular month and end on the last day of that month. (See List/Attachment 13-5-C).
2. 
When a towing service has the primary towing coverage for a particular month they will be the first towing service contacted for any and all towing calls for service when the vehicle owner/operator does not request a particular service.
3. 
The order of the rotation will be determined by a blind draw, at a date and time to be determined by the Chief of Police, which all approved participating towing services will be invited to attend.
4. 
The set rotation will stay in effect for a two-year time period at which time a new blind draw will take place establishing a new rotation, unless the Township desires to end this process.
5. 
A new towing service cannot be added to the approved towing service list once the towing service rotation is established. Any new towing service must make applications to be added at the time of the next scheduled blind drawing.
6. 
If, for any reason, the towing service that has the primary towing coverage is unavailable for or unable to complete a towing call for service, the towing service that is next in line will be assigned to the call.

1. 
Towing responsibilities in a primary towing coverage month are not permitted to be leased, sublet, or transferred to another towing service. If a towing service must relinquish its primary coverage month, it must so notify the Township of North Fayette Police Chief in writing as soon as it is aware of the situation. The towing service must identity the reasons why it cannot meet its towing service primary coverage obligations for the month(s) assigned. Any month so relinquished will be reassigned as follows:
A. 
The first 15 days of the month or portion thereof to be transferred will become the responsibility of the tow operator who had the preceding month.
B. 
The remainder of the month to be transferred will become the responsibility of the tow operator who has the next available month.
2. 
The Township reserves the right to alter the above transfer of primary towing responsibilities as it deems necessary in order to most fairly distribute tow operators coverage more equally.

1. 
Towing service must verify the availability of indoor storage space for at least two medium sized vehicles under their control and on owner's business location. The storage of vehicles towed at the premises where the towing service conducts business will allow law enforcement agencies and/or the owner to quickly know where to find a towed vehicle. Remote storage of vehicles can be inconvenient for law enforcement agencies and/or owners and can result in vehicles not being under the constant control of the tower.
2. 
Township police or other law enforcement agencies should have access to the secured storage area to accomplish inventories, prepare necessary reports or conduct investigations.
3. 
Towed vehicles cannot be stored on Township or state road right-of-way.

1. 
The Township reserves the right to relieve a towing service of their privilege to tow vehicles through this system if the tow operator is not available when required, i.e., on primary coverage or if complaint(s) are received about tow operators which would warrant removal from this list.
2. 
The Township reserves the right to relieve a towing service of their privilege to tow vehicles through this system for false, misleading or incomplete information as well as for failure to promptly communicate changes in the status of personnel or equipment as required.
