The Borough Fire Marshal shall be appointed by the Borough Council at a regular monthly meeting. The Borough Fire Marshal shall serve a two-year term. At the end of the term, he may then be reinstated or a new person will be elected to fill the position for a two-year term.

The Borough Fire Marshal shall be selected by the Borough Council. He or she will hold this position for the full term unless voted out by the Borough Council by a majority vote.

The following minimum education and experience shall be necessary to qualify for appointment to the office of Borough Fire Marshal:
A. 
Education.
(1) 
Shall have a valid high school diploma.
(2) 
Shall be able to speak and read English.
(3) 
Shall have completed the basic firefighting school.
(4) 
Shall have completed the advanced firefighting school.
(5) 
Shall have completed the Commonwealth of Pennsylvania arson detection school.
(6) 
Shall have completed an approved course in hazardous materials.
B. 
Experience.
(1) 
Shall have at least five years as a firefighter.
(2) 
Shall have served at least one year as an assistant fire chief.
(3) 
Shall have served at least two years as a fire chief.

The Borough Council shall decide on a yearly operating budget for the Fire Marshal to work with.
2. 
The budget shall be used for equipment, office supplies, schooling, vehicle mileage, and for Fire Prevention Material, and other supplies and material deemed necessary to carry out the duties of Borough Fire Marshal.

This code and the BOCA Basic/National Fire Prevention Code, "there which is a part of the said ordinance and adopted by reference to," shall serve as the authoritative guide for the Borough Fire Marshal.

The Borough Fire Marshal shall have the following power and duties:
A. 
Fire Suppression. The Borough Fire Chief will be in command of all fire suppression in the Borough. After the fire is declared under control, the fire scene will then be turned over to the Borough Fire Marshal. If there is no Chief Officer on the Fire Scene, the Fire Marshal will be in command until the first Chief Officer arrives on the scene.
B. 
Investigation of Fires.
(1) 
To investigate all fires which occur within the Borough in order to determine the cause thereof.
(2) 
To provide a copy of the investigation to the Borough Council and/or Police Chief when requested.
(3) 
To work with and provide the necessary support and assistance to local and State Police on fire investigations.
C. 
Enforcement of Codes.
(1) 
The Borough Fire Marshal will enforce the Fire Code as adopted by the Commonwealth of Pennsylvania under the Uniform Construction Code [Chapter 5, Part 4, "Uniform Construction Code"].
(2) 
To inspect all buildings and all properties and to enforce the State and Borough Fire Code.
(3) 
To assist firefighting units by surveying buildings and recording their construction, occupancy, hazards, and fire protection systems. The Borough Fire Marshal shall advise the area fire companies of this information, and shall arrange tours if requested.
D. 
Insurance Rating Authorities.
(1) 
To consult with the insurance companies and to convey to the Borough Council the requirements for fire protection which are acceptable to the insurance ratings authorities.
E. 
Public Education.
(1) 
To develop and conduct public education programs on fire safety.
F. 
Records and Evidence.
(1) 
The Fire Marshal shall keep records of all inspections, fires, and hazardous material incidents, and shall inform the Borough Fire Chief, Police Chief, and Borough Council of all inspections.
(2) 
To maintain a record(s) on file at the borough Municipal Building of any and all investigations and/or reports relating to the duties of his office.
(3) 
If in the opinion of the Fire Marshal photographs of a scene are required, he shall take such pictures or, if necessary, request the Borough Police or other agents to provide the necessary photographs.

The Borough Fire Marshal shall also serve as the Assistant State Fire Marshal.

In the absence of the duly appointed Fire Marshal, the Borough Fire Chief shall assume the duties of the Borough Fire Marshal.

The Borough Fire Chief and his assistants shall assist the Borough Fire Marshal in the enforcement of the Administrative Codes.

The Borough Fire Marshal will be furnished the following equipment by the Borough of Morton:
A. 
Helmet.
B. 
Turnout coat.
C. 
Bunker pants.
D. 
Boots.
E. 
Portable radio.

The Borough Fire Marshal shall be compensated by Borough Council for his services with an annual stipend of $4,000. Such stipend may be adjusted from time to time by Borough Council through adoption of a resolution.
