To provide for the needs of local, retail business establishments serving the nearby community and to encourage their development in convenient, suitable locations.

1. 
The following are the permitted uses of land and buildings in the NC district:
A. 
Retail stores and businesses serving the everyday needs of the community not including and excepting therefrom adult motion picture theaters, adult mini-motion picture theaters, adult cabarets, and adult bookstores.
B. 
Establishments serving food or beverages such as restaurants, cafes, confectioneries, and ice cream shops; provided, however, that no such establishment shall be conducted wholly or partially as a drive-in or drive-through service establishment, providing service to customers in automobiles or service of food and/or drinks for immediate consumption outside the building in which the business is conducted.
C. 
Professional and business offices.
D. 
Personal service shops (barbers, tailors, shoe repair, laundry pick-up, etc.)
E. 
Financial institutions (banks, savings and loan associations, etc.), excluding drive-in facilities.
F. 
General service and repair shops (radio, T.V., appliance repair, etc.), and excluding auto repair services.
G. 
Municipal or governmental administrative offices.
H. 
Accessory buildings and uses customarily incidental to the above when located on the same lot.
I. 
Parking areas and lots (commercial and private).
J. 
Uses which, in the opinion of the Borough Council, are of the same general character as the above uses and which will not be detrimental to the intended purposes of this chapter.

The following uses are permitted by special exception granted by the Zoning Hearing Board:
A. 
Residence in combination with a permitted commercial use, provided that no residence shall be located on the first floor of any structure.
B. 
Mid-rise apartments in accordance with the provisions of § 27-708.
C. 
Club or lodge.
D. 
Drive-in financial institution.
E. 
Uses which, in the opinion of Borough Council, are of the same general character as the above uses and which will not be detrimental to the intended purposes of this chapter.

Minimum Lot Area.
A. 
Commercial uses: 2,500 square feet.
B. 
Residences in conjunction with a commercial uses: 2,500 square feet/DU.
2. 
Minimum Lot Width.
A. 
Commercial uses: 25 feet.
B. 
Mid-rise apartments: see § 27-708.
3. 
Maximum Lot Coverage.
A. 
Commercial uses-no more than 75% of any lot shall be covered by buildings, and not more than 90% shall be covered by buildings and other impervious surfaces.
B. 
Mid-rise apartment development in accordance with § 27-708.

Commercial Uses.
A. 
Minimum setback distance from a street right-of-way: 10 feet.
B. 
Minimum side yard setbacks-none, except that where a side yard at least 10 feet in width shall be provided which shall remain undeveloped and planted in accordance with the provisions of § 27-1510. Where a side lot line abuts a street, a setback of 10 feet from the street right-of-way shall be provided.
C. 
Minimum rear yard setback: 25 feet.

No building shall exceed 35 feet or three stories in height, whichever is lesser.
