GENERAL REFERENCES
Flood damage prevention — See Ch. 105.
As used in this chapter, the following terms shall have the
meanings indicated:
Includes mobile homes, trailers, trailer coaches, camp trailers,
house trailers, camp cars and any other vehicle or unit used or intended
for conveyance upon the public streets so designed or constructed
as to permit occupancy of the vehicle or unit by one or more persons
as a temporary or permanent dwelling, business place or sleeping place
or for other occupancy or use by persons, equipped with wheels or
other locomotive devices and capable of being transported from place
to place either under its own power or by attachment to a motor vehicle
or other means of transportation.
Any place, area, lot site or tract of land occupied by or
used at the present time or at any future time by two or more mobile
homes, or available for such occupancy or use, with or without charge,
and shall include any building, structure, tent, camp, cottage or
enclosure used or intended for use as part of or in connection with
such mobile home park. The term "mobile home park" shall not be construed
to include motels or permanent cabins for hire.
Any individual, firm, partnership, corporation or association
of persons.
A.
Required. It shall be unlawful for any person to erect, construct,
maintain, operate or permit to be erected, operated or offered for
public use within the Township a mobile home park without first obtaining
a license therefor from the Township Committee.
B.
Application.
(1)
Application for such license shall be submitted, in writing, to the
Township Clerk, signed by the owner of the premises to be licensed,
and shall set forth the following:
(a)
Name and address of the owner of the premises.
(b)
Name and address of the person if different from the owner of
the premises intending to manage and operate the mobile home park.
(c)
Metes and bounds descriptions of the premises to be licensed.
(d)
A detailed statement of provisions made for the disposal of
trash, garbage and other waste materials.
(e)
A statement from the Health Officer of the Township that all
facilities required by the ordinances and regulations of the Board
of Health of the Township have been provided.
(2)
Each application shall have attached a certified copy of the resolution
of the Zoning Board of Adjustment granting a special exception use
and a zoning permit authorizing the construction and operation of
the mobile home park, together with the approved site plan thereof,
and a certificate of occupancy. The licensee shall further be held
liable to continue in compliance with all of the provisions of the
standards pertaining to mobile home parks set forth in Section 13-12
of the Township Zoning Ordinance.[1] Failure to comply with the Zoning Ordinance shall be cause
for suspension or revocation of any license issued hereunder.

Each application for a license shall be accompanied by an inspection
fee of $25, payable to the Township of Knowlton.
(4)
Upon receipt of such license application in proper form, the Township
Clerk shall refer the same to the Health Officer, Building Inspector
and Fire Chief. Each such officer shall forthwith review the application
and view the proposed site and either approve or disapprove the application,
setting forth, in writing, his reasons therefor. The application shall
then be referred to the Township Committee for final determination
as to whether the application shall be granted or refused.
C.
Use of trailers regulated; storage provision.
(1)
No person owning or leasing or having possession or control of any
mobile home, as defined herein, shall occupy or use the same, or permit
the same to be occupied or used, upon any lot or tract of land for
any purpose whatsoever (even as an accessory building or use) within
the Township except upon and within a mobile home park conducted,
maintained and licensed by the Township for such purposes, in full
and complete compliance with all the provisions of this chapter.
(2)
This section shall not, however, prohibit residents of the Township
from storing on the same premises on which they reside campers, trailers
or mobile homes owned by them for recreational purposes and vacation
use off the premises, provided that such campers, trailers or mobile
homes may not under any circumstances at any time within the Township
be used for residential purposes, nor shall this section prohibit
the temporary use of trailers owned and occupied by patrons of approved
private campgrounds between May 15 and October 31.
The provisions of this chapter shall be applicable to every
mobile home park in the Township and to any person maintaining, operating,
conducting or permitting the same, and shall be applicable to any
person living or sleeping in any mobile home in any mobile home park,
as well as the owner and operator of the premises and other persons
having an interest in the mobile home park or any mobile home therein.
Dogs shall not be permitted to run at large in any mobile home
park at any time.

A.
The annual license fee for each mobile home park shall be $200, and
the license period shall be the fiscal year, beginning July 1. No
apportionment of any license fee shall be made. No license shall be
transferred without the express approval of the Township Committee
and an express undertaking by the transferee to conform with this
chapter and all other municipal, state and federal regulations.
B.
In addition to the annual license fee prescribed in the preceding
subsection, the licensee shall pay to the Township a license fee of
$9.50 per mobile home for each week or part thereof during which any
one mobile home is located within the licensed mobile home park.
C.
On or before the 10th day of each calendar month, the licensee shall
file with the Township Clerk a report, under oath, stating the number
of mobile homes occupying his licensed premises within the preceding
calendar month, the duration of each such occupancy, the state, territory
or country which issued the license plates on each trailer and accompanying
motor vehicle and the license numbers thereof, and the name and home
address of each mobile home owner. At the time of the filing of each
monthly return, the licensee shall pay to the Township Clerk the weekly
license fee prescribed in the preceding subsection for the preceding
month.
D.
The fee for transfer of the annual license shall be $25.
A.
It shall be the duty of the licensee to keep a register containing
a record of all mobile home owners and occupants with the licensed
mobile home park at all times. Such register shall contain the following
information:

Such register shall be kept available for inspection by the Township
Committee, the Township Board of Health and the Township Board of
Education, as well as health and law enforcement officers. Such record
shall be retained and shall not be destroyed for a period of three
years following the date of the last registration of the mobile home
in such register, and the departure of the mobile home so registered,
whichever is later.
Any license granted hereunder shall be subject to revocation
or suspension by the Township Committee in the following manner:

A notice shall be served on the person holding such license, specifying
wherein he has failed to comply with the rules, regulations, laws
and ordinances of the Township and requiring such licensee to appear
before the Township Committee at the time and place therein specified
not less than five days after the service of such notice, requiring
such licensee to show cause at such time and place why the license
should not be revoked or suspended.
B.
At the time and place mentioned in the notice, the licensee shall
have the right to appear in person, or by counsel, and introduce such
relevant, competent and material evidence as he may desire, and the
licensee shall be confronted with the charges against him and relevant,
competent and material proof thereof. All witnesses shall be subject
to cross-examination.
C.
After the hearing, the Township Committee shall make a finding of
fact and thereupon, in its discretion, revoke or suspend the license,
make such terms as will provide a reasonable opportunity to the licensee
to comply with any violation or dismiss the charges.
