The Board of Supervisors of New Hanover Township does hereby create and establish an Environmental Advisory Board to consist of five members, who shall be appointed by motion of the Board of Supervisors. The members of the Environmental Advisory Board shall by majority vote designate one of their members to act as Chairman for such periods as may be designated by the Environmental Advisory Board. The Board of Supervisors may, at its discretion, adopt by resolution a charter for the Environmental Advisory Board, establishing the goals and objectives to be accomplished. Any resolution so enacted may be amended from time to time by further resolution of the Supervisors.
A. 
Term of Office. Environmental Advisory Board members shall serve for three years except that initial appointments shall be staggered so that the terms of no more than two Board members shall expire each year, the terms of their successors to be of three years each.
B. 
Vacancies in Office. The Board of Supervisors of New Hanover Township shall have the exclusive authority to appoint members to the Environmental Advisory Board in the event of a vacancy on the Board as a result of the resignation, the death or the removal of a member of the Board prior to the expiration of his/her term. The appointment by the Board of Supervisors to the vacant seat shall be for the balance of the unexpired term. Upon expiration of the term, the Board of Supervisors shall then make an appointment for a full three-year term.

Recognizing the complexity of environmental legislation and the very significant impact environmental issues have on the ordinary citizen, the Board of Supervisors of New Hanover Township desires supplementary advice on implementing an environmental policy within the Township. The Environmental Advisory Board will be a citizen based, environmental action group whose primary pledge is to keep the New Hanover Township Board of Supervisors at the forefront of environmental planning, legislation and public education.

It is intended that the mission of the Environmental Advisory Board will be to identify various environmental concerns impacting New Hanover Township which include, but are not limited to, water, air, land, noise and light pollution. Based on community needs and input, the Environmental Advisory Board will evaluate waste disposal and recycling programs, promote the preservation of natural resources and educate the community regarding environmental matters. The Environmental Advisory Board will provide support and advice on environmental matters to the New Hanover Township Board of Supervisors when requested.

The Environmental Advisory Board is directed to and is charged with the responsibility of identifying the unique physical circumstances and natural resources including, but not limited to, the location and quality of elements including the air, land and water as may be located within the territorial limits of New Hanover Township; and, in furtherance of said directive, the Environmental Advisory Board is directed to identify critical environmental issues and problems as may arise within the Township and draft plans or proposals to address such problems and issues and recommend the same for consideration by the several agencies and boards responsible for development and monitoring of the use, occupation, growth and development of properties within the community. To accomplish the directive, the Environmental Advisory Board, once duly appointed, may request that the Board of Supervisors adopt or amend a Charter specifically identifying the responsibilities of each member of the Board and the Board as a whole.

The Environmental Advisory Board is also directed to make recommendations regarding possible use and retention of open space by keeping an index of such open space areas as are publicly and privately owned to the extent that they may impact upon the acquisition of property by the Township and preservation of areas by respective developers which will preserve the unique physical characteristics of the Township and general neighboring community. It being the specific intent of the Board of Supervisors to foster and encourage the protection, conservation, management and promotion of the natural resources of the community and to allow the constituents of New Hanover Township to enjoy the continued use and preservation of the environment.
