From and after the enactment of this chapter, the following
regulations shall be effective for proper conduct or behavior when
using the facilities of the parks, including pools, of the Borough
of Adamstown.
A.
Alcoholic beverages shall not be permitted in the park or pool areas
at any time.
B.
Trash, garbage and all other litter must be placed in containers
provided for this purpose.
C.
No one shall remove, molest, injure or damage anything natural or
physical within all parks and pool areas and within the tennis or
basketball courts areas. No bikes, skateboards, roller blades, scooters
or any other type of wheeled item may be used on any basketball court
or tennis court.

D.
Motor vehicle operators shall obey posted speed limits and parking
restriction signs, and use only roads and parking areas open to the
public for vehicular traffic.
E.
The operation of unlicensed motorized vehicles and snowmobiles is
prohibited in the park area.
F.
No person shall discharge within any Borough park or recreational
facility any firearms as that term is defined by § 6120(b)
of the Pennsylvania Uniform Firearms Act[1] except for the justifiable use of force as authorized
by Chapter 5 of the Pennsylvania Crimes Code.[2] No person shall use or possess within any Borough park
or recreation facility any bow and arrow, slingshot, air rifle or
any other device (other than firearms as defined above) capable of
throwing any projectile of any sort, including the hand throwing of
rocks or stones intended to be used as weapons. This section shall
not be operative in any specific area now designated or to be designated
in the future by the Borough as a rifle range, archery range, or any
other specific area whose purpose is to allow the activities otherwise
prohibited by this section.

G.
All parks in the Borough will be open for the use of its facilities
from dawn until dusk. Permission to remain in the park after dusk
shall be obtained from the Mayor or the Chief of Police.

H.
No person or persons shall enter or use the swimming pool or any
building or buildings appurtenant thereto at any time after the established
closing hour. Permission to remain in the pool area after the established
closing hours must be obtained from the Recreation Board.
I.
No person or persons shall commit a breach of the peace, be guilty
of vagrancy, riotous or disorderly conduct; engage in fighting, assaults,
quarreling, or inciting others to fight, tending to imperil personal
security or endanger the property of the Borough.
J.
No person or persons shall use publicly profane, blasphemous or indecent
language, or commit open lewdness or any act of public indecency,
make any indecent exposure of the person; be found in a state of intoxication
or drunkenness.
K.
No person or persons shall make willfully or cause to be made any
loud, boisterous or unseemly noise or disturbance to the annoyance
of the peaceable occupants thereof and residents nearby.
L.
No person or persons shall ride on the back of or lead or drive a
horse anywhere within any Borough park without obtaining prior permission
from the Mayor or the Chief of Police.

M.
No person shall permit any dog or other animal except wildlife to
run at large in any Borough park. Any person who shall bring any dog
or other animal onto any Borough park shall at all times attend to
and maintain control of such animal. All dogs shall be maintained
on a leash.

Any person convicted of a violation of any of the provisions
of this chapter shall, upon conviction thereof before a Magisterial
District Judge, be sentenced to pay a fine of not less than $25 nor
more than $600 and the costs of prosecution for each and every offense,
plus the cost of all damages inflicted on the Borough park, including,
but not limited to, damages to the pools, tennis courts and/or basketball
courts. Such persons shall also be required to reimburse the Borough
for all reasonable attorneys' fees the Borough incurs in enforcement
provisions in accordance with Section 3321(6) of the Borough Code,
as reenacted and amended by Act 43 of 2012.[1]
