§ 120-1 Purpose.

This chapter is to define the process for utilization of the Township-owned concession trailer. It will also outline the rules, fees and responsibilities for public use as well as use by private nonprofit organizations that benefit Lumberton Township residents.

§ 120-2 Responsibilities.

A.
The Recreation Commission or its appointed designee is responsible for assigning usage schedule and calendar for the concession trailer for all venues and events.
B.
The Recreation Commission or its appointed designee is only responsible for selecting, purchasing and restocking provisions to be sold through the concession for Township events not affiliated with a private group or club. Only items identified or approved by the Commission will be sold through the concession.
C.
Private groups and clubs are responsible for purchasing and stocking all materials to be sold from the concession trailer during their scheduled games and events. This includes all dry goods including napkins, cups, plates and cleaning supplies.
D.
Private groups and clubs are responsible for the removal of all materials they have moved into the trailer for scheduled games and events. No materials may be left or stored in the concession trailer at the end of an event. The trailer must be left in the same condition as it was in at the start of any game or event.
E.
The Recreation Commission is responsible for securing and maintaining all requisite permits to operate the concession.
F.
The Recreation Commission or its appointed designee is responsible for general maintenance and upkeep of the concession.
G.
The Recreation Commission or its appointed designee is responsible for movement and placement of the concession trailer between Township facilities and properties. The concession will be located and moved to Township-approved locations only.
H.
General cleanup of the concession is the responsibility of the organization using the concession. Each private group or club utilizing the trailer is expected to leave the trailer in a clean and organized manner that will be ready to be used by the next group.

§ 120-3 Usage priority.

A.
Township-sponsored activities take first priority in usage of the concession trailer before private groups or clubs.
B.
Utilization and scheduling of the trailer for non-Township events will be predetermined by the Recreation Commission. The Commission will use a schedule of games and events submitted at a set date by all private groups and clubs interested in utilizing the trailer. The Commission will equally divide the potential days requested by each group or club.

§ 120-4 Staffing.

A.
During Township-organized or sponsored recreational events or activities, the concession will be staffed by participant volunteers or by part-time hourly Recreation Commission hired employees.
B.
Private groups and clubs are responsible for staffing the concession during their sponsored sports activities or events.
C.
Private groups and clubs are responsible for training all staff, state-required Board of Health training and certifications.
D.
Clubs, groups, and societies who staff the trailer will sign-in and indicate the condition (cleanliness and functionality) of the trailer utilizing the form provided by the Recreation Commission.
E.
Clubs, groups, and societies who staff the trailer will sign-out and indicate the condition (cleanliness and functionality) of the trailer utilizing the form provided by the Recreation Commission.
F.
Private groups and clubs will submit their season, event, game or venue schedules for a rental season at a date to be published by the Recreation Commission along with a signed rental agreement submitted with a security deposit of $200 and a "seasonal" rental fee of $100.
G.
The concession will not be available for commercial use (for-profit private use).

§ 120-5 Financial obligations.

A.
Access to the trailer is granted to private groups or clubs who pay the Township "field use fee" for the "season" covered by the "field use fee" through three steps:
(1)
A mandatory security deposit of $200 is required with each application.
(2)
A nonrefundable rental fee of $100 is required for each "rental season" as defined as March through June and August through November.
(3)
At the end of each rental season each group or club is required to submit a payment to Lumberton Township representing 10% of the profits from all concession-related (nonapparel or club accessory) sales. The payment amount is to be determined by the private group or club and submitted with supporting documentation on sales and expenses.
B.
A one-day rental fee for private groups or clubs who do not pay a "field use fee" is available for $100 per day. This must be submitted along with a refundable security deposit of $200.
