The Borough shall adopt, establish and implement an Occupancy
Inspection Program for portions of commercial properties and/or buildings
within the Borough. The owner or lessee of said properties and/or
buildings shall be required to obtain a certificate of occupancy,
prior to occupying said properties and/or buildings. Certificates
of occupancy shall be issued by the Building Code Official only after
inspection reveals said properties are compliant with the Pennsylvania
State Uniform Construction Code and current NFPA Codes.

The owner or lessee of said properties and/or buildings shall
make arrangements with the Borough to schedule inspections to obtain
certificates of occupancy.

Any violation discovered during inspection shall require the
Building Code Official to give written notice to the property owner
or lessee, stating all violations, and to give the owner or lessee
30 days' notice to correct, abate, repair or otherwise remove the
violations.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof, shall be sentenced to a fine
of not more than $1,000 plus costs and, in default of payment of said
fine and costs, to a term of imprisonment not to exceed 30 days. Each
day that a violation of this Part continues or each section of this
Part which shall be found to have been violated shall constitute a
separate offense.

Fees for inspections and certificates of occupancy shall be in an
amount as established from time to time by resolution of Borough Council.

Properties and buildings that have building permits issued under
the Pennsylvania State Uniform Construction Code shall not be required
to pay the certificate of occupancy inspection fee for the building
or portion thereof under construction.
