Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this Part for any person to park a vehicle or allow it to remain parked otherwise.

1. 
Definitions. As used in § 15-404, the following terms shall have the meanings indicated:
COMMERCIAL MOTOR VEHICLE
A. 
A motor vehicle designed or used to transport passengers or property:
(1) 
If the vehicle has a gross vehicle weight rating of 17,001 or more pounds or such lesser rating as the department shall adopt under the provisions of Section 6103(c) (relating to promulgation of rules and regulations by Department), as determined by federal regulation and published by the Department as a notice in the Pennsylvania Bulletin;
(2) 
If the vehicle is designed to transport 16 or more passengers, including the driver;
(3) 
If the vehicle is a school bus; or
(4) 
If the vehicle is transporting hazardous materials and is required to be placarded in accordance with Department regulations.
B. 
The term does not include an antique or classic motor vehicle, or an implement of husbandry, or any motor home or recreational trailer operated solely for personal use, or motorized construction equipment, including, but not limited to, motorscrapers, backhoes, motorgraders, compactors, excavators, tractors, trenchers and bulldozers.
COMMERCIAL SEMITRAILER
A freight trailer that when attached is supported at its forward end by the fifth wheel device of the truck tractor.
RECREATIONAL VEHICLES
Any vehicular-type unit used primarily for recreational purposes including, but not limited to, boats, boat trailers, personal watercraft carriers, personal watercraft trailers, travel trailers, tent trailers, pickup campers or coaches (designed to be mounted on automotive vehicles), motor coaches, motorized homes, and nonmotorized vehicles.
COMMERCIAL TRACTOR TRAILER
A large truck with a long trailer attached to the back of it.
UTILITY TRAILERS
Any wheeled structure, without motive power, designed to be towed by a motor vehicle and which is generally and commonly used to carry and transport personal effects and/or property.
2. 
Permitted Parking of Certain Vehicles. Utility trailers, recreational vehicles, commercial vehicles, commercial tractor trailers, and commercial semitrailers may be temporarily, legally parked or stored on any public Borough highway, street or alley between the hours of 7:00 a.m. and 7:00 p.m. for the purpose of loading, unloading, trip preparation, or minor, routine maintenance and repair.
3. 
Prohibited Parking of Certain Vehicles. It shall be unlawful for any person to park, or to allow to remain parked, on any highways, streets, alleys, cartways, or parts of highways, streets, alleys, or cartways any vehicle other than a passenger-type motor vehicle between the hours of 7:00 p.m. and 7:00 a.m.
4. 
A violation of any part of this section shall be subject to penalties as set forth in Chapter 15 of the Borough of Forty Fort Code of Ordinances. Each day the violation occurs shall constitute a separate offense.
5. 
This section shall become effective immediately upon its enactment and adoption by Borough Council and shall be immediately enforceable as provided by law in order to properly effect the parking of trucks, buses and certain other vehicles as provided for in this section.

1. 
Findings and Purpose. The Borough finds that:
A. 
Certain residential areas in the Borough are subjected to commuter vehicle parking, therefore depriving the residents of those areas of spaces in which to park their own vehicles.
B. 
Those residential streets are also subjected to a high degree of commuter traffic which substantially reduces the quality of the ambient air level.
C. 
The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Borough considers it to be in the interest of the people of the Borough to provide for the establishment of a residential permit parking program to insure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.
2. 
Definitions. For the purpose of this section, words and terms listed in this subsection, as follows, shall have the following meanings:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area.
PROPRIETOR
A person who owns or leases real estate within a residential area of which he is not a resident, but who owns or manages a business enterprise or professional office maintained at that address. For the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address.
RESIDENT
A person who owns or leases real property within a residential area and who maintains either a voting residence or bona fide occupancy, or both, at that address.
RESIDENTIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and nonbusiness property (such as schools, parks, places of worship, hospitals and nursing homes).
3. 
Criteria. The residential areas designated in Subsection 4 of this section are those deemed impacted and hence eligible for residential parking on the basis of the following criteria:
A. 
During any period between the hours of 7:00 a.m. and 6:30 p.m., Monday through Saturday, except legal holidays, the number of vehicles parked (or standing), legally or illegally, on the streets in the area is equal to 70% or more of the legal, on-street parking capacity of the area, for the purpose of this criterion, a legal parking space shall be 20 linear feet.
B. 
During the same period as specified in paragraph .A, 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in the area, for the purpose of this criterion, the latest available information from the Pennsylvania Department of Transportation regarding registration of motor vehicles shall be used.
Provided: in determining that a specific area identified as impacted and eligible for residential permit parking is designated as a residential permit parking area, the following factors are taken into consideration:
(1) 
The local and metropolitan needs with respect to clean air and environment.
(2) 
The possibility of a reduction in total vehicle miles driven in the Borough.
(3) 
The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards.
(4) 
The proximity of public transportation to the residential area.
(5) 
The desire and need of the residents for residential permit parking and their willingness to bear the administrative costs in connection with it.
(6) 
The need for parking in excess of the residential permit parking program in proximity to establishments located in the residential permit parking area and used by the general public for religious, health or educational purposes.
4. 
Designation of Residential Permit Parking Areas. The following are designated as residential permit parking areas:

Signs shall be erected along the streets in each residential permit parking area, indicating the days, hours, locations and conditions under which parking shall be by permit only.
5. 
Application for Permit. Application for a residential parking permit shall be made to the Chief of Police by the person desiring the permit, who shall be only the owner or the driver of a motor vehicle who resides on or is a proprietor of property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, in an amount as established by resolution of the Borough, which shall be for the use of the Borough, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident or the proprietor, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the applicant's current driver's license. At the discretion of the Chief of Police, the applicant shall be required, at the time of making application, to present his driver's license and the vehicle registration card.
6. 
Issuance of Permit. Upon receipt of the application and the permit fee, and determination by him that the information upon the application shows that the applicant is entitled to a residential parking permit, the Chief of Police shall issue to the applicant a residential parking permit, which shall be valid for the remainder of the calendar year. The permit shall display the serial and registration numbers of the motor vehicles, the residential parking area number and the expiration date. The permit shall be renewable annually before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
7. 
Temporary and Exemption Parking Permits. Temporary parking permits may be issued by the Chief of Police, upon payment of a fee in an amount as established by resolution of the Borough Council, to bona fide visitors of residents of a designated residential permit parking area, and exemption parking permits may be issued, without payment of a fee, to handicapped persons.
8. 
Responsibility of Permit Holder.
A. 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
B. 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
C. 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
D. 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Chief of Police in order to obtain a residential parking permit.
9. 
Revocation of Permits. The Chief of Police shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to the present holder of the revocation, the permit holder shall surrender the permit to the Chief of Police. Failure to do so, when so requested, shall constitute a violation of this section. Provided, any person receiving such a notice may, within 10 days after the date of the notice, appeal to the Borough for a hearing on the revocation, and the decision of the Borough shall be final.

From and after the passage of this Part, no motor vehicle shall be permitted to remain parked or left standing on a highway, street or alley of said Borough between the hours of 2:00 a.m. and 5:00 a.m., except that on-street parking permits shall be provided to Borough residents. This section will pertain only to passenger-type motor vehicles or automobiles or trucks. Commercial trailers and camper-type vehicles are not permitted to park between 7:00 p.m. and 7:00 a.m. upon a Borough highway, street or alley.
2. 
Said residents will make application to the office of the police or designated Borough officer, who shall issue permits to those individuals meeting the above qualifications upon approval by Forty Fort Borough. Residents may obtain a special temporary overnight on-street parking permit from the Borough for a period of up to five days to permit parking on a highway, street or alley of said Borough between the hours of 2:00 a.m. and 5:00 a.m. Council, by resolution, shall determine the fee for said special permit.

Definitions.
CARTWAY OR ROADWAY
The paved portion of any street, whether public or private designed for vehicular traffic and on-street parking, exclusive of the sidewalk, berm, shoulder, or tree lawn.
CLEAR SIGHT TRIANGLE
An area of unobstructed vision at street intersections defined by lines of the sight between points 75 feet from the intersection of street center line.
DRIVEWAY
A privately owned and maintained access constructed to connect a public or private roadway with an adjacent property, and intended to provide vehicular access into that property in a manner that will not cause the blocking of any sidewalk, tree lawn, shoulder, or street roadway.
DRIVEWAY APRON
The portion of the driveway located within the sidewalk and tree lawn areas (public right-of-way) connecting private driveway to the cartway of a street.
SIDEWALK
The concrete walkways, located along any public or private roadway, designed solely for public pedestrian use, without regard to ownership.
TREE LAWN
The section of land between the sidewalk (or right-of-way line if no sidewalk exists) and the curb, shoulder, or edge of the pavement of a public or private roadway, intended for planting of vegetation.
2. 
It shall be unlawful for any person to park a vehicle or allow it to remain parked on any tree lawn or portion thereof within the Borough of Forty Fort.
3. 
Persons may park a vehicle on a driveway apron, if the vehicle does not block any portion of the sidewalk, cartway, roadway or the clear sight triangle.
4. 
All parking areas other than a driveway apron within a public right-of-way must be surfaced with a bituminous or cement concrete surface. Where the right-of-way is owned and maintained by PennDOT, a permit will be required for any construction performed upon the state right-of-way.
5. 
Where off street parking areas are provided on curbed streets adjacent to the cartway, a depressed curb area shall be provided to access the parking area.
6. 
Parking shall be prohibited within 25 feet of any corner or road.

1. 
Controls and Regulations. The Borough of Forty Fort does hereby establish the following controls and regulations of the parking of motor vehicles on the streets, alleys, and roadways within the Borough of Forty Fort:
A. 
No vehicle shall be stored upon any street. As used herein "stored" shall mean the parking of a vehicle in one place upon any street continuously for over 72 hours ($25).
B. 
No person shall park a vehicle in a prohibited area, on a street during days posted by the borough as street sweeping ($10).
C. 
No person shall park a vehicle within 25 feet of a corner of any street in the Borough ($15).
D. 
No person shall park a vehicle within 15 feet of a fire hydrant ($35).
E. 
No person shall park a vehicle within 30 feet of a control signal, yield sign, or stop sign ($15).
F. 
No person shall park a vehicle at any time facing against the flow of traffic ($20).
G. 
No person shall double park or park a vehicle on the traveled portion of a street, alley, or roadway. This includes parking a vehicle more than 10 inches from the curb ($20).
H. 
No person shall park or leave on the streets, highways or public property of the Borough, any vehicle without a current inspection sticker unless the vehicle is legally parked in front of, or in close proximity to, an official Pennsylvania State Inspection Station which identifies said vehicle by work order specifying a state inspection will be performed within 24 hours. Additional work orders beyond the initial twenty-four-hour period are prohibited ($20).
I. 
No person shall park or leave on the streets, highway, or public property of the Borough any vehicle without displaying a current and valid registration plate ($15).
J. 
No vehicle shall stand on any street or sidewalk for the purpose of greasing or repair work except in case of emergency repairs ($20).
K. 
No person shall park a vehicle at any time in front of, or in such a position as to block entrance or exit by a vehicle from a garage or driveway ($25).
L. 
No person shall park any vehicle, on any street in the Borough between the hours of 2:00 a.m. to 5:00 a.m., without an official Borough parking permit ($15).
M. 
No person shall park any vehicle other than a passenger-type motor vehicle between the hours of 7:00 p.m. and 7:00 a.m. (see § 15-404) ($15).
N. 
No person shall park a vehicle on a tree lawn of any street in the Borough ($15).
O. 
No vehicle shall be parked on any sidewalk, crosswalk, or any other designated pedestrian only designated walkway ($20).
P. 
No person shall park a motor vehicle or to allow that vehicle to remain parked anywhere on any snow emergency route designated in § 15-903 ($25).
Q. 
No person shall park a motor vehicle or to allow that vehicle to remain parked in any temporary restricted parking zone that has been posted by the Forty Fort Police Department, and/or Department of Public Works ($25).
R. 
No person shall park a motor vehicle on any street, between signs that have been authorized by the Borough of Forty Fort to designate the section of the street as a "Loading/Unloading" Zone ($15).
S. 
No person shall park a vehicle in a handicapped zone without an official handicapped license plate, or placard ($50 to $200).
2. 
Violations and Penalties.
A. 
For violation of Subsection 1B, street sweeping, the vehicle shall be subject to a penalty of $10. If the fine is not paid within five days, an additional assessment of $5 shall be made. Failure to pay the full amount of the fine within 15 days of the date of the original notice of violation will result in a citation being filed with the District Justice, at which time the fine would be increased to no less than $25 and no more than $50.
B. 
For violation of Subsection 1C, 25 feet of a corner; Subsection 1E, 30 feet of a control signal, yield sign, or stop sign; Subsection 1I, current and valid registration plate; Subsection 1L, 2:00 a.m. to 5:00 a.m. parking, Subsection 1N, tree lawns, or Subsection 1R, Loading/Unloading Zones, the vehicle shall be subject to a penalty of $15. If the fine is not paid within five days, an additional assessment of $5 shall be made. Failure to pay the full amount of the fine within 15 days of the date of the original notice of violation will result in a citation being filed with the District Justice, at which time the fine would be increased to no less than $25 and no more than $50.
C. 
For violation of Subsection 1F, parked against traffic; Subsection 1G, double parking; Subsection 1H, expired inspection; Subsection 1J, repair work, or Subsection 1O, sidewalk or crosswalk, the owner/operator or vehicle shall be subject to a fine of $20. If the fine is not paid within five days, an additional assessment of $5 shall be made. Failure to pay the full amount of the fine within 15 days of the date of the original notice of violation will result in a citation being filed with the District Justice, at which time the fine would be increased to no less than $25 and no more than $50.
D. 
For violation of Subsection 1A, stored vehicle; Subsection 1K, blocking garage or driveway; Subsection 1P, snow emergency route, or Subsection 1Q, temporary restricted parking zone, the vehicle shall be subject to immediate tow and a penalty of $25. If the fine is not paid within five days, an additional assessment of $5 shall be made. Failure to pay the full amount of the fine within 15 days of the date of the original notice of violation will result in a citation being filed with the District Justice, at which time the fine would be increased to no less than $30 and no more than $50.
E. 
For violation of Subsection 1D, fire hydrant, the vehicle shall be subject to immediate tow and a penalty of $35. If the fine is not paid within five days, an additional assessment of $5 shall be made. Failure to pay the full amount of the fine within 15 days of the date of the original notice of violation will result in a citation being filed with the District Justice, at which time the fine would be increased to no less than $35 and no more than $50.
F. 
For violation of Subsection 1S, handicapped parking, the owner/operator shall pay a fine of $50. If the fine is not paid within five days, an additional assessment of $5 shall be made. Failure to pay the full amount of the fine within 15 days of the date of the original notice of violation will result in a citation being filed with the District Justice, at which time the fine would be increased to no less than $75 and no more than $200.
G. 
Each day the owner or operator of the vehicle is in violation of any part in this section, it shall constitute a separate offense and fines and/or additional assessments will be given.
