This Part shall be known and may be cited as "the Borough of Doylestown Valet Parking Ordinance."

1. 
As used in this Part, the following words and phrases shall have the meanings as indicated:
VALET PARKING AREA
An area designated under Chapter 15, § 315, to be used for the dropoff and pickup of automobiles by valet parking operators and their customers.
VALET PARKING OPERATOR
Any person, partnership, corporation or any other type of entity engaged in the business of operating a valet parking area and parking automobiles in a separate parking lot on behalf of customers for a short-term period of time and later retrieving them, for which it charges a fare or price agreed upon in advance between the operator and the customer.

It shall be unlawful for a valet parking operator to conduct its business within the Borough without first having obtained a license as provided in this section. A valet parking operator license shall not be transferable.

Any person desiring to obtain a license for the operation of valet parking shall make separate application, in writing, to the Borough for the granting of a license, which application shall be made upon forms to be furnished by the Borough. The applicant shall give such information as may, from time to time, be deemed by the Borough as requisite to determine the fitness of the applicant to conduct the business. In particular, the applicant shall provide proof that it has made arrangements to use permitted off-street parking area(s) for the parking of customer cars and that no streets will be used for the parking of vehicles. Every applicant for a license must be at least 18 years of age. No application shall be accepted by the Borough unless the same shall be accompanied by the full amount of the license fee as provided in the Borough's Fee Schedule.

Licenses issued under this Part shall be effective upon issuance and, unless terminated earlier, shall automatically terminate one year from the date of issuance.

The fee for an owner's license shall set by resolution of the Borough Council.

A certificate of insurance, as proof of coverage, must be filed with the Borough Secretary; liability minimum limits to be at least $1,000,000, naming the Borough as an additional insured. The operator must file copies of written proof with the owners of property for use of their parking facilities.

Hours of operation for valet parking areas shall be established in the license and are subject to review and change at the Borough's discretion.

A valet parking operator shall:
1. 
File its rate schedule with the Borough.
2. 
Display its rate schedule during hours of operation so that it is visible to customers.
3. 
Display the Borough's phone number as a place to which complaints concerning the valet parking operations can be directed.

The design and location of valet parking signs shall be approved in advance by the Borough.
2. 
Valet parking signs shall be removed after each day of operation.
3. 
Valet parking signs shall not impede pedestrian or vehicular traffic in the area.

No smoking is permitted while operating customers' vehicles.
2. 
All employees shall be equipped with employee identification to show the entity or individual by whom they are employed.
3. 
Shirts, jackets or caps shall also identify the valet parking operator.
4. 
Drivers shall be clean in person and fully dressed while on duty.
5. 
Drivers must be at least 18 years of age and possess a valid drivers' license (submit copies of drivers' licenses with application form).
6. 
Drivers cannot refuse customers and must be courteous at all times.
7. 
Customers shall be serviced on a first-come, first-served basis.
8. 
Vehicles must be locked and keys secured while under valet parking operator possession; Doylestown Borough is not responsible for loss of any property.
9. 
Pedestrian and vehicular traffic shall not be impeded.
10. 
Members of the public who are not utilizing valet parking services shall be allowed to use valet parking areas for loading and unloading without charge or interference.
11. 
The Borough shall be notified when drivers resign, and new drivers' forms must be filed with the Borough within 24 hours of hiring new drivers.

Nothing in this Part shall be construed to relieve a licensee from compliance with any applicable Borough, state or federal law or regulation, and it shall be the responsibility of each licensee under this Part to comply with all such state laws and regulations.

Any license issued pursuant to this Part may be permanently revoked or suspended at any time for a violation of any provision of this Part or for other good cause shown by the Zoning Officer, Code Enforcement Officer, Borough Manager, Chief of Police or Borough Council.

Any person violating any of the provisions of this Part upon conviction thereof, may be fined up to $1,000 or as provided for in the Borough Code.
