City of Lincoln, AR Chapter 14.20 Annexing, Vacating and Re-Zoning

§ 14.20.01 Annexing certain lands.

A. Scope of application. From and after the effective date of this ordinance, the lands described herein shall be annexed to the City of Lincoln and the said described lands are hereinafter referred to as the annexed territory.

B. Findings of fact. Following thorough investigation and study, the City Council does hereby find the following matters to be factual:

1. The territory proposed for annexations contiguous to the present corporate limits of the City of Lincoln.

2. The annexed territory represents the actual growth of the municipality beyond its legal boundary;

3. The annexed territory is needed for the extension of lawful police and fire service and regulation; and

4. The annexed territory is valuable by reason of its adaptability for prospective municipal purposes.

C. Territory annexed. In reliance on the foregoing, the City Council does hereby annex the lands described on Attachment No. 1 subject to the election scheduled hereafter.

D. Schedule of Services.

1. The City Council expressly declares that municipal services will be extended to the annexed territory pursuant to the following schedule within three years.

2. Water, sanitation collection, fire and police protection and street maintenance: 30 days after the effective date hereof.

3. The City Council hereby declares its intent to extend sewer collection service to the newly annexed area within eight years of the date of ratification of this ordinance.

E. Assignment to ward. The lands herein annexed shall be and constitute a part of Wards II and III of the City. All that property lying north of U.S. Hwy 62 shall accrue to and become a part of Ward II.

F. Election scheduled.

1. The City Council does hereby fix the date of June 27, 2000, as the date for conducting a referendum election on this ordinance in the manner prescribed by A.C.A. § 14-40-303 and the general election laws of this state.
