The Borough hereby adopts by reference the regulations and requirements applicable to clothing bins as set forth in N.J.S.A. 40:48-2.60 et seq. The definitions as set forth in N.J.S.A. 40:48-2.60 are likewise incorporated by reference into this article of the Code. The "appropriate municipal agency" established by resolution shall maintain on file a copy of N.J.S.A. 40:48-2.60 et seq. for the reference of Borough residents and businesses.
A. 
The appropriate municipal agency shall charge annually a fee of $25 per clothing bin to offset the cost involved in enforcing this article of Chapter 247.
B. 
All permits for clothing bins shall be for a period of one year, and any expiring permits may renewed upon an application filed with the appropriate municipal agency and the payment of an annual renewal fee of $25 per clothing bin.
C. 
The appropriate municipal agency shall develop an application form and permit to be issued for the placement of each clothing bin to be placed within the Borough of Highland Park.
Clothing bins shall only be authorized by the appropriate municipal agency to be placed in nonresidential zoning districts throughout the Borough of Highland Park.
No person or entity may remove any of the contents of a clothing bin unless authorized by the owner of said bin.
Penalties for the violation of any permit issued by the appropriate municipal agency with regard to the placement or maintenance of a clothing bin shall be in accordance with the general penalty provisions of the Code, § 1-17 herein.
