Districts. For the purpose of this chapter, present and future, provision is hereby made for the division of the Village of Monticello into the following nine basic zoning districts:

A. 
Vacation of streets. Vacation of public streets and alleys shall cause the land vacated to be automatically placed in the same district as the abutting side to which the vacated land reverts.
B. 
Annexations. Annexations to or consolidations with the Village subsequent to the effective date of this chapter shall be placed in the R-1 Single-Family Residential District, unless the annexation ordinance places the land in another district.
A. 
The Village of Monticello is hereby divided into Zoning Districts as shown upon a map designated as the Official Zoning Map of the Village of Monticello and made a part of this chapter. The Official Zoning Map and all the notations, references and other information shown thereon are a part of this chapter and shall have the same force and effect as if the matters and information set forth by said map were fully described herein. The Official Zoning Map shall be properly attested and kept on file along with the text of the Official Zoning Regulations in the office of the Village Clerk-Treasurer of the Village of Monticello.
B. 
The district boundaries shall be determined by measurement from and as shown on the Official Zoning Map, and in case of any question as to the interpretation of such boundary lines, the Plan Commission shall interpret the map according to the reasonable intent of this chapter. Unless otherwise specifically indicated or dimensioned on the map, the district boundaries are normally lot lines; section, quarter section or sixteenth section lines; or the center lines of streets, highways, railways or alleys.
Where uncertainty exists as to the boundaries of districts as shown on the Zoning Map, the following rules shall apply:
A. 
Boundaries indicated as approximately following the center lines of streets, highways or alleys shall be construed to follow such center lines.
B. 
Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.
C. 
Boundaries indicated as approximately following Village boundaries shall be construed as following municipal boundaries.
D. 
Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.
E. 
Boundaries indicated as following shorelines shall be construed to follow such shorelines and, in the event of change in the shoreline, shall be construed as moving with the actual shoreline; boundaries indicated as approximately following the center lines of streams, rivers, canals, lakes or other bodies of water shall be construed to follow such center lines.
F. 
Boundaries indicated as parallel to or extensions of features indicated in the preceding shall be so construed. Distances not specifically indicated on the Zoning Map shall be determined by the scale of the map.

A minimum one hour fire rated wall assembly division, separating living areas from the lowest level to flush against the underside of the roof, is required between each dwelling unit.

Permitted uses. Two-family dwellings and multifamily dwellings on a lot not less than 10,000 square feet in area and 100 feet in width, public parks and playgrounds.

The following uses provided that they shall be retail establishments selling and storing merchandise: Apartment hotels, appliance stores, bakeries, barber shops, bars, beauty shops, business offices, caterers, churches, clinics, clothing repair shops, clothing stores, clubs, crockery stores, cocktail lounges, confectioneries, delicatessens, department stores, drugstores, electrical supply, financial institutions, furniture stores, furniture upholstery shops, gift stores, grocery stores, hardware stores, heating supply, hobby shops, hotels, house occupations, laundry and dry cleaning establishments, liquor stores, lodges, meat markets, music stores, newspaper offices and pressrooms, night clubs, office supplies, optical offices, pawn shops, personal service establishments, pet shops, places of entertainment, photographic supplies, plumbing supplies, printing, private clubs, private schools, publishing, radio broadcasting studios, restaurants, second-hand stores, self-service and pickup laundry and dry cleaning establishments, signs, soda fountains, sporting goods, supermarkets, taverns, television broadcasting studios, tobacco stores, trade and contractor's offices, upholsterers' shops, variety stores and vegetable stores. Residences are permitted only on upper floors of business establishments. Existing residences shall comply with all the provisions of the R-3 Residential District.
B. 
Conditional uses.
(1) 
Governmental and cultural uses, utilities, public passenger transportation terminals.
(2) 
Apartments, dwelling units and lodging rooms over business establishments.
(3) 
Farm machinery and equipment sales and storage, feed and seed stores not to include grinding or processing operations; food locker plants; wholesaling and warehousing, provided all principal structures and uses are at least 50 feet from any lot line.
(4) 
Funeral homes, provided all principal structures and uses are not less than 25 feet from any lot line.
(5) 
Drive-in establishments serving food or beverages for consumption outside the structure; motels.
(6) 
Drive-in banks.
(7) 
Vehicle sales and service, washing and repair stations, garages, taxi stands and public parking lots, provided all gas pumps are not less than 30 feet from any side or rear lot line and 20 feet from any existing or proposed street line.
(8) 
Commercial service facilities, such as fueling stations, provided all such services are physically and sales-wise oriented toward industrial district users and employees and other users are only incidental customers.

Any other use similar in character with the permitted uses and retail sales of products manufactured, assembled or treatment of products clearly incidental to the conduct of a retail business on the premises.

Purpose. This district is designed to accommodate those retail, service and office uses characteristic of the original "downtown" area of the Village.
B. 
Permitted and conditional uses. Permitted and conditional uses and buildings allowed in the B-1 Business District.

Dimensions. The maximum height, side, rear and front yards, minimum lot width and parking for new or converted buildings can correspond with typical existing development layout of the district provided the plan commission determines such development is in keeping with the purposes, design and character of the central business district and is architecturally compatible with the downtown area. Side and rear lot line to Accessory Structure remain the same as B-1 business district.
A. 
Permitted uses. Agriculture, dairying, floriculture, forestry, general farming, grazing, greenhouses, hatcheries, horticulture; livestock raising; feed lots; nurseries, orchards, paddocks, pasturage, poultry raising, stables, truck farming and viticulture. Farm dwellings for those resident owners and laborers actually engaged in the principal permitted uses are accessory uses and shall comply with all the provisions of the R-2 Residential District.
B. 
Conditional uses.
(1) 
Commercial raising, propagation, boarding or butchering of animals, such as dogs, mink, rabbits, foxes, goats and pigs; the commercial production of eggs and the hatching, raising, fattening or butchering of fowl, provided such operations are limited to a distance of at least 200 feet from all adjacent dwellings.
(2) 
Archery ranges, golf courses, riding academies, sports fields, stadiums and swimming pools, provided that the lot area is not less than 50 feet from any district boundary.
(3) 
Commercial recreation facilities, such as arcades, bowling alleys, clubs, dance halls, driving ranges, gymnasiums, lodges, miniature golf, physical culture, pool and billiard halls, indoor rifle ranges, Turkish baths, skating rinks and theaters.
(4)

Manufacture, fabrication, processing, packaging and packing of confections, cosmetics, electrical appliances, electronic devices, food, except cabbage, fish and fish products, meat and meat products and pea vining; instruments; jewelry; pharmaceuticals; tobacco and toiletries. Existing residences shall comply with all the provisions of the R-3 Residential District.
B. 
Conditional uses.

Animal hospitals, provided the lot area is not less than three acres and all principal structures and uses are not less than 100 feet from any residential district.

Manufacture and processing of abrasives, acetylene, acid, alkalies, ammonia, asphalt, batteries, bedding, bleach, bone, cabbage, candle, carpeting, celluloid, cement, cereals, charcoal, chemicals, chlorine, coal tar, coffee, coke, cordage, creosote, dextrine, disinfectant, dye, excelsior, felt, fish, fuel, furs, gelatin, glucose, gypsum, hair products, ice, ink, insecticide, lampblack, lime, lime products, linoleum, matches, meat, oil cloth, paint, paper, peas, perfume, pickle, plaster of paris, plastics, poisons, polish, potash, pulp, pyroxylin, radium, rope, rubber, sausage, shoddy, shoe and lamp-blacking, size, starch, stove polish, textiles and varnish. Manufacturing, processing and storage of building materials, explosives, dry ice, fat, fertilizer, flammables, gasoline, glue, grains, grease, lard, plastics, shellac, soap, turpentine, vinegar and yeast. Manufacture and bottling of alcoholic beverages. Bag cleaning, bleacheries, canneries, cold storage, warehouses; electric and steam generating plants; electroplating; enameling; forges; foundries; garbage; incinerators; lacquering; lithographing; offal, rubbish or animal reduction; oil, coal and bond distillation; refineries; road test facilities; slaughterhouses; smelting; stockyards; tanneries and weaving, provided they are at least 600 feet from residential districts.
(5) 
Outside storage and manufacturing areas. Wrecking, junk, demolition and scrap yards shall be surrounded by a solid fence or evergreen planting screen completely preventing a view from any other property or public right-of-way and shall be at least 600 feet from residential districts.

Setbacks for I-1 are the same as for B-1.
A. 
Permitted uses. Grazing, orchards, pasturage, truck farming, crop farming; forestry; public parks and playgrounds. The above uses shall not involve the dumping, filling, mineral, soil or peat removal or any other use that would disturb the natural watercourses or topography. Residences and principal farm buildings are not permitted.
B. 
Conditional uses.
(1) 
All structures, except ordinary farm fences.
(2) 
Conditional uses as provided in Article V of this chapter.

The requirements for property in the R-MH Mobile Home District shall be as provided in Article XII of this chapter.
A. 
Purpose. The Village recognizes that consequences of certain land use activities, whether intentional or accidental, can seriously impair groundwater quality. The purpose of the Municipal Well Recharge Area Overlay District (MW) is to protect municipal groundwater resources from certain land use activities by imposing appropriate restrictions upon lands located within the approximate groundwater recharge area of the Village's municipal wells. The restrictions imposed herein are in addition to those of the underlying residential, commercial or industrial zoning districts or any other provisions of the Zoning Ordinance.
B. 
Overlay zones. The Municipal Well Recharge Area Overlay District is hereby divided into Zone A and Zone B as follows:
(1) 
Zone A is identified as the primary source of water for the municipal well aquifer and as the area most likely to transmit groundwater contaminants to the municipal wells. Zone A is more restrictive than Zone B.
(2) 
Zone B is identified as a secondary source of water for the municipal well aquifer and as an area where there is a lower probability of surface contaminants reaching the municipal well fields. Zone B is less restrictive than Zone A.
(3) 
Conditional uses as provided in Article V of this chapter.

Zone A prohibited uses. The following land uses are hereby found to have a high potential to contaminate or have already caused groundwater contamination problems in Wisconsin and elsewhere. The following principal or accessory uses are hereby prohibited within Zone A of the Municipal Well Recharge Area Overlay District:
(1) 
Areas for dumping or disposing of garbage, refuse, trash or demolition material.
(2) 
Asphalt products manufacturing plants.
(3) 
Automobile laundries (car washes).
(4) 
Automobile service stations.
(5) 
Building materials and products sales.
(6) 
Cartage and express facilities.
(7) 
Cemeteries.
(8) 
Chemical storage, sale, processing or manufacturing plants.
(9) 
Dry cleaning establishments.
(10) 
Electronic circuit assembly plants.
(11) 
Electroplating plants.
(12) 
Exterminating shops.
(13) 
Fertilizer manufacturing or storage plants.
(14) 
Foundries and forge plants.
(15)

E. 
Zone B prohibited uses. The following principal or accessory uses are hereby prohibited within Zone B of the Municipal Well Recharge Area Overlay District:

Underground petroleum products storage tanks for industrial, commercial, residential or other uses.
F. 
Zone B conditional uses. The following conditional uses may be allowed in the Municipal Well Recharge Area Overlay District, subject to the provisions of Article V:

Any business or industrial use.
(2)
