A. 
Definitions. As used herein, the following terms shall have the following meanings:
ELECTRIC VEHICLE
Vehicle that uses electricity stored in a battery as its sole means of propulsion.
ELECTRIC VEHICLE CHARGING STATION
A public or private parking space that includes dedicated battery charging equipment for the primary purpose of transferring electric energy to an electric vehicle's battery or other energy storage device.
MUNICIPAL FLEET VEHICLE
A vehicle that the City of Hoboken either owns or is registered to an entity performing official City business.
NONELECTRIC VEHICLE
A vehicle that does not meet the definition of "electric vehicle" or "plug-in hybrid electric vehicle" as provided herein.
PLUG-IN HYBRID ELECTRIC VEHICLE or PHEV
Vehicle that uses electricity stored in a battery and a gasoline-powered internal combustion engine as a means of propulsion.
PRIVATELY OWNED OR OPERATED ELECTRIC VEHICLE CHARGING STATIONS
Electric vehicle charging stations that are owned or operated by a private entity but are located in the public right-of-way for public use and operate with the explicit permission of the City of Hoboken.

B. 
Off-street public parking spaces. The City hereby designates parking spaces at each of the following off-street public parking locations for use as electric vehicle charging stations.

(1) 
Green pass electric vehicle municipal parking program. This section establishes the rules and procedures governing a pilot program for discounted municipal garage parking for electric vehicles to begin at the effective date of this subsection and extend six months therefrom.

(a) 
Green pass eligibility. Residents who have established their residency in accordance with § 141A-2 to the Hoboken Parking Utility and have a registered electric vehicle that meets the definitions of electric vehicle and plug-in hybrid electric vehicle in Subsection A.
(b) 
Discounted parking rates. Green pass holders may pay a discounted rate of $6 for up to eight hours or part thereof of parking for their registered vehicle at participating municipal garages. After eight hours, the green pass holder must pay the prevailing garage rate for the remaining time that their vehicle is housed within the participating municipal parking garage.
(c) 
Discounted parking locations. Green pass vehicles may pay the discounted parking rate at Garage B, located at 28 2nd Street, Garage D, located at 215 Hudson Street, and Midtown Garage, located at 371 4th Street.
(2) 
In addition to the prevailing garage rate, the following electric vehicle charging fees shall apply for the garage parking spaces listed above:
(a) 
For each hour or part thereof while the vehicle is charging: $1.
(b) 
For each hour or part thereof while the vehicle is not charging but remains plugged in to an electric vehicle charging station: $3.
(3) 
Nonelectric vehicles are prohibited from stopping, standing, and parking at electric vehicle charging stations.
(4) 
Electric vehicles are entitled to a five-minute grace period between the time the driver arrives at the electric vehicle charging station and when charging commences.
C. 
On-street parking spaces. The City hereby designates on-street parking spaces at each of the following locations for use as electric vehicle charging stations.

Anyone parked at an electric vehicle charging station is responsible for paying the prevailing on-street metered rate.
(2) 
Additionally, the following electric vehicle charging fees shall apply for the on-street parking spaces listed above:
(a) 
For each hour or part thereof while the vehicle is charging: $1.
(b) 
For each hour or part thereof while the vehicle is not charging but remains parked in one of the designated parking spaces: $3.
(3) 
Electric vehicles using an on-street electric vehicle charging station for vehicle charging shall not be exempt from other posted curbside parking regulations.
(4) 
Nonelectric vehicles are prohibited from stopping, standing, and parking at an electric vehicle charging station.
(5) 
Electric vehicles are entitled to a five-minute grace period between the time the driver arrives at the electric vehicle charging station and when charging commences.
D. 
Parking spaces for municipal fleet vehicles. The City hereby designates spaces at each of the following locations for use as electric vehicle charging stations for municipal fleet vehicles.

F. 
Violations.
(1) 
Offenders of this article shall be subject to the following fee schedule:
(a) 
First-time offense: $75.
(b) 
Second-time offense: $125.
(c) 
Additional offenses: $150 per offense.
(2) 
Offenders may also be subject to any applicable fines outlined in the Hoboken City Code at § 190-44.
