A. 
The following words, terms and phrases, as used in this Article VII, shall have the meanings given herein, except where the context in which the word or phrase is used clearly indicates otherwise. When not inconsistent with the context, words used in the singular include the plural and words in the plural include the singular and words used in the present tense include the future. The word "shall" is mandatory.
B. 
As used in this Article VII, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Lemoyne, Cumberland County, Pennsylvania.
BOROUGH MANAGER
The person appointed by the Lemoyne Borough Council to serve in the position as Borough Manager.
CLEARED AND/OR TREATED PORTION OF A PUBLIC STREET OR ROAD
That portion of a public street or road which has been plowed or otherwise cleared of snow or which has been treated with deicing or antiskid material.
ENTITY
Any organization, other than an individual person, whether in the form of a partnership, joint venture, association, corporation (whether for or not for profit) or otherwise.
ICE
Frozen water, whether as a result of precipitation or otherwise.
MAYOR
Elected public official with authority to declare a snow emergency pursuant to the Borough Code, 8 Pa.C.S.A. § 10A06(b).
OWNER
The legal or equitable owner of real property abutting sidewalks or streets.
PERSON
A natural person.
PROPERTY OWNER
Any person or persons, male or female, corporation, partnership, association, company, individual, owner, occupant, lessee, tenant or organization in the Borough of Lemoyne, PA.
PUBLIC STREET OR ROAD
Any street or road within the territorial limits of the Borough of Lemoyne as maintained by the Borough or the commonwealth.
SIDEWALK
Any space located between the curbline or the lateral line of a cartway of a street or highway and the adjacent property line or right-of-way line of a street or highway, intended for use by pedestrians, whether improved or unimproved.
SNOW
Natural frozen precipitation.
SNOW OR ICE EMERGENCY
A state of condition(s) which may include whenever snow falls during any period of 12 hours or less to an accumulative depth of three inches or more, or at any other such time, at the discretion of the Mayor or the Mayor's designee.
STREET
Any road within the Borough, maintained by either the Commonwealth of Pennsylvania or the Borough.
TENANT
Any occupant, lessee, tenant or person, other than the property owner, having charge of any building, lot or parcel of ground abutting the sidewalk or street.
VEHICLE
Any mobile machine designed to transport passengers or cargo upon a street, including a trailer or semitrailer, except devices used exclusively upon rails or tracks.
A. 
In order to facilitate the movement of traffic and to combat hazards of excessive snow or ice on the streets or portions of streets identified in § 525-45 herein, the Mayor or the Mayor's designee, in his/her discretion, may declare an emergency due to such hazards, thereby implementing the motor vehicle parking and operating restrictions set forth in this Article VII.
B. 
Notice of the declaration of a snow or ice emergency shall be given through media outlets, social media, the Borough's website and the Borough's emergency notification system.
C. 
Notification of termination of a snow or ice emergency shall be provided to the media for announcement.
A. 
Upon declaration of a snow or ice emergency by the Mayor, it shall be unlawful during the period of the emergency for any vehicle to be parked on those streets, or those portions of streets, identified in § 525-45 of this Article VII.
B. 
It shall be unlawful to operate any motor vehicle upon those streets named in § 525-45 of this Article VII, unless such vehicle is equipped with adequate facilities to provide sufficient traction to keep the vehicle safely in motion so that other traffic traveling on the streets will not be blocked or seriously impeded.
C. 
During the snow emergency or ice emergency parking restrictions, certain other parking restrictions such as parking on front and side yards of residences shall be relaxed.
D. 
Upon the lifting of the snow emergency or ice emergency, regular parking regulations shall apply unless otherwise notified.
In order to assist motorists in determining the streets affected, the Mayor or Borough Manager is hereby directed to place signs reading

SNOW TIRES OR CHAINS REQUIRED
NO PARKING DURING EMERGENCY
VEHICLES TOWED AWAY
on poles on streets, or portions of streets, designated in § 525-25 herein. Said signs shall be conspicuously displayed in each block and placed on the side of the street where the parking restrictions are to be enforced.

A. 
Any police officer or law enforcement officer of the Borough is hereby authorized to issue a citation to the owner or operator of a vehicle for any traffic and/or parking violation under the provisions of any ordinance of the Borough or for any of the traffic or parking prohibitions contained in this Article VII.
B. 
After such emergency has been declared and at any time while such emergency shall be in effect, any motorist whose vehicle is illegally parked or has become stalled within the affected streets listed in § 525-45 by reason of his or her failure to have such vehicle properly equipped with the facilities hereinbefore prescribed shall be guilty of a violation of this article and, upon conviction therefor before the Magisterial District Judge, shall be sentenced to pay a fine of at least $50 and no more than $1,000, plus the cost of prosecution, or imprisonment for a period not to exceed 30 days in the event said fine remains unpaid 30 days following the date of conviction. In addition, when any vehicle shall have been removed and towed to any auto tow pound, such vehicle can be recovered only upon the payment of towing and storage charges as prescribed by the Borough.
