In expansion of the declaration of legislative intent and the statement of community development objectives contained in Article I, §§ 95-2 and 95-3, of this chapter, it is the specific intent of this article to:
A. 
Set reasonable standards and provide reasonable controls to assure sufficient parking capacity for the uses or potential uses of land in the Borough;
B. 
Provide flexibility in the implementation of these standards by permitting construction of a reduced number of parking spaces under appropriate conditions;
C. 
Prevent hazards to public safety caused by the intrusion and congestion of parking upon public rights-of-way;
D. 
Provide a pedestrian-friendly environment to foster a less vehicular intensive linkage throughout the Commercial District;
E. 
Provide safe and convenient vehicular access and parking.
A. 
Compliance with the Subdivision and Land Development Ordinance required. All new or expanded parking areas shall meet the requirements of Chapter 85, Subdivision and Land Development.
B. 
Vehicular access. Vehicular access to surface parking areas shall be from an alley or side street where feasible.
C. 
Pedestrian access. Safe provisions for pedestrian access to and through a parking lot shall be required.
D. 
Maximum parking. No more than 125% of the minimum parking requirement shall be provided.
A. 
Minimum required parking shall be provided according to Table 13.1, Minimum Parking Requirements.
(1) 
When a minimum parking requirement is noted as "per unit," this refers to the number of separate dwelling units.
(2) 
When a minimum parking requirement is noted as per a set "SF GFA," this refers to the square feet of gross floor area of the building(s) associated with the applicable use.
B. 
When the calculation of the minimum required parking spaces results in a fractional number, fractions equal to or over 0.5 shall be rounded up to the nearest whole number and fractions under 0.5 shall be rounded down to the nearest whole number.
C. 
When multiple uses are proposed in a single building or on a single lot, the sum of the parking requirements for each use shall be provided unless said uses are covered under § 95-123F, Shared parking.

A. 
Calculation.
(1) 
The calculation of the minimum parking requirement shall take into account any applicable reductions as permitted by § 95-123B, C, D, and E prior to calculating any shared-use parking reduction as provided for by § 95-123F.
(2) 
Minimum parking requirements for residential uses shall not be reduced except as provided for by § 95-123F, Shared parking, or by variance from the Zoning Hearing Board.
B. 
Parking reduction for existing nonresidential properties on Main Street. Existing nonresidential properties in the Borough Commercial or Borough Residential District which have their primary frontage on Main Street shall not be required to provide new off-street parking when changing from one nonresidential use to another nonresidential use.
C. 
Parking reduction for existing nonresidential buildings. When a new nonresidential use is proposed within an existing nonresidential building, the first 1,000 square feet of gross floor area shall be excluded from the calculation of the minimum parking requirement.
D. 
Utilization of on-street parking. When legally established on-street parking spaces exist along a property's frontage(s), any spaces located entirely within the frontage (as determined by extending the side property lines outward from the property lines) may be counted towards meeting the minimum nonresidential parking requirement; any space that extends beyond the frontage shall be disregarded.
E. 
Utilization of public parking. Borough Council shall have the authority to reduce the minimum parking requirement by up to 25% for nonresidential uses located on lots within 750 feet of a Borough-owned parking facility via conditional use approval and subject to the following:
(1) 
Distance. The 750-foot measurement shall be calculated between the nearest parking space of a public parking facility and the nearest entrance to the subject nonresidential use.
(2) 
Parking space utilization and availability. All public parking spaces within a Borough-owned lot shall remain open to the public for general use. The parking spaces approved for a private, nonresidential use shall not be marked or otherwise noted as being reserved for the specific use or business; however, businesses may publicize the location of available public parking facilities.
(3) 
Compliance with Chapter 53, Municipal Parking Lots, is required.
F. 
Shared parking.
(1) 
Shared parking reductions are available for multiple uses on:
(a) 
Single or multiple adjacent sites under single ownership; and
(b) 
Multiple contiguous sites with a shared-use parking agreement for sharing parking facilities.
(2) 
A shared parking agreement, approved by the Borough Solicitor, shall be filed with the Zoning Officer.
(a) 
The owner of the shared parking facility shall guarantee availability of the required spaces for the associated use and meet their minimum requirement.
(b) 
The shared parking facility may utilize shared parking to reduce the total spaces within the facility in accordance with Table 13.2, Mixed-Use and Shared Parking.
(3) 
Shared parking location.
(a) 
The shared parking facility shall be located within 500 feet, measured from lot line to the nearest lot line of the parking facility, of the associated use.
(b) 
Shared parking shall be calculated according to Table 13.2, Mixed-Use and Shared Parking.
(4) 
Shared parking shall be calculated using the peak demand calculations listed in Table 13.2, Mixed-Use and Shared Parking, using the following system:
(a) 
First, calculate the minimum amount of parking required for each land use as if it were a separate use (including any applicable parking reductions per § 95-123B, C, D, and/or E).

The Zoning Officer shall determine the appropriate category of use as noted in Chart 13.2, Mixed-Use and Shared Parking.
(b) 
To determine the peak parking requirements, multiply the minimum parking required for each proposed land use by the corresponding percentage in the table below for each of the time periods.
(c) 
Calculate the column total for each time period.
(d) 
The column (time period) with the highest value shall be the minimum parking requirement.

The minimum required parking as determined by Table 13.1, Minimum Parking Requirements, may be held as reserve parking without actually paving the spaces when authorized as a special exception by the Zoning Hearing Board. The grant of authorization by the Zoning Hearing Board shall be subject to the following:
A. 
Expansion of use. Where a use regulated by Table 13.1, Minimum Parking Requirements, is being expanded and the Board determines that the additional number of parking spaces required by this expansion are not currently needed, it may authorize the applicant to hold in reserve the number of spaces that the Board determines are not currently required to meet the needs of the uses to which the property will be put.
B. 
New or changed use. Where a new use regulated by Table 13.1, Minimum Parking Requirements, is created or there is a change of use on the property, and the Board determines that the number of parking spaces required is not currently needed, it may authorize the applicant to hold in reserve up to 50% of the total number of spaces required.
C. 
The applicant shall document that the full number of required parking spaces can be paved without violating any applicable provisions of this chapter or Chapter 85, Subdivision and Land Development. When constructed, the reserve parking shall meet all applicable provisions of this chapter as of the date the construction permit is sought.
D. 
The applicant shall install stormwater management facilities, as required by the Subdivision and Land Development Ordinance, for the total required number of parking spaces, including those held in reserve, unless the applicant demonstrates to the Board's satisfaction that the economic and practical benefit of currently installing such facilities for the reserve parking spaces is not significant when compared to the destruction that would be caused to natural features on the site.
E. 
The applicant shall agree in a recorded covenant, approved by the Borough Solicitor, to install the reserve parking spaces at any future time if and when the Zoning Officer determines that the reserve parking spaces are needed to accommodate the use of the property. The applicant may appeal such order to the Zoning Hearing Board.
F. 
Regardless of the number of spaces actually developed, a parking area to accommodate the aggregate number of parking spaces required shall be fully designed, and the area held as reserve parking shall be clearly designated on the plan. The reserve parking area shall be considered in calculating the impervious surface ratio. The parking reserve area shall be planted with vegetative cover and integrated into the site's land development plan. Such area shall be required to be developed as designed if and when the Zoning Officer determines the need.
G. 
A financial guaranty shall be provided by the applicant to cover the cost of installation of the parking spaces held in reserve for a period of one year following installation of the initially constructed parking spaces. The type and dollar value of the guaranty shall be approved by the Borough Council upon recommendation of the Borough Solicitor and Borough Engineer.
A. 
For new construction, service and loading areas shall be to the side and rear of the building. Loading docks shall not be on the main street and shall be visually screened from the street and sidewalk.
B. 
The location and size of loading areas shall be adequate for the safe maneuvering and parking of trucks, so that ingress and egress can occur on the lot without backing out onto a public street.
C. 
Loading areas shall be lit to provide security and safety; however, lighting shall be shielded to prevent glare onto adjacent properties.
