The Fire Chief or any other officer of any fire department providing firefighting services for a property within this Town, which is outside the Village of Penn Yan, shall notify the Code Enforcement Officer of any fire or explosion involving any structural damage, fuel-burning appliance, chimney or gas vent within a reasonable amount of time but no greater than five business days.
Fire safety and property maintenance inspections of buildings and structures shall be performed by the Code Enforcement Officer at the following intervals:
A. 
At least once every 12 months for buildings which contain an assembly area; and
B. 
At least once every 12 months for public and private schools and colleges, including any buildings of such schools or colleges containing classrooms, dormitories, fraternities, sororities, laboratories, physical education, dining, or recreational facilities; and
C. 
At least once every 36 months for multiple dwellings and all nonresidential occupancies.
A. 
In addition to the inspections required by this Part 3, a fire safety and property maintenance inspection of any building or structure may also be performed by the Code Enforcement Officer at any time upon:
(1) 
The request for an inspection by the owner or owner's agent; or
(2) 
Receipt by the Code Enforcement Officer of a complaint as prescribed in this chapter that alleges violations of any applicable provision of the codes as well as the Code of Town; and
(3) 
Receipt by the Code Enforcement Officer of any other information, reasonably believed by the Code Enforcement Officer to be reliable, giving rise to reasonable cause to believe that conditions or activities failing to comply with the Uniform Code or Energy Code exist.
B. 
However, nothing in this section shall be construed as permitting an inspection under any circumstances under which a court order or warrant permitting such inspection is required, unless such court order or warrant shall have been obtained.
It shall be the duty of the owner or the owner's agent to schedule a fire safety and property maintenance inspection with the Code Enforcement Officer. It shall be the duty of the owner or the owner's agent to provide access to and means for inspections of the buildings and structures that are required to be inspected by this chapter. It shall be the duty of the owner or owner's agent to accompany the Code Enforcement Officer at the scheduled fire safety and property maintenance inspection.
A. 
General. Nothing in this chapter shall supersede, limit or impair the powers, duties and responsibilities of OFPC and the NYS Fire Administrator under § 156-e of the Executive Law of NYS and §§ 807-a and 807-b of the Education Law of NYS, as currently in effect and as hereafter amended from time to time, or any successor rules, regulations or statutes.
B. 
Acceptance. Notwithstanding any other provision of this section to the contrary, the Code Enforcement Officer may accept an inspection performed by the OFPC or other authorized entity pursuant to §§ 807-a and 807-b of the Education Law and/or § 156-e of the Executive Law, as currently in effect and as hereafter amended from time to time, or any successor rules, regulations or statutes, in lieu of a fire safety and property maintenance inspection performed by Code Enforcement personnel or a third-party inspector, provided that:
(1) 
The Code Enforcement Officer is satisfied that the individual performing such inspection satisfies the requirements set forth in 19 NYCRR 1203.2(e) as currently in effect and as hereafter amended from time to time, or any successor rules, regulations or statutes; and
(2) 
The Code Enforcement Officer is satisfied that such inspection covers all elements required to be covered by a fire safety and property maintenance inspection; and
(3) 
Such inspections are performed no less frequently than once a year; and
(4) 
A true and complete copy of the report of each such inspection is provided to the Code Enforcement Officer; and
(5) 
Upon receipt of each such report, the Code Enforcement Officer takes the appropriate action prescribed by this chapter.
The Code Enforcement Officer has the right to have a third-party inspector conduct fire safety and property maintenance inspections as prescribed by this chapter to ensure compliance with the Uniform Code.
At the discretion of the Code Enforcement Officer, a remote virtual inspection may be performed in lieu of an in-person inspection when, in the opinion of the Code Enforcement Officer, this form of inspection can accomplish the same level and quality as an in-person inspection and it shows to the satisfaction of the Code Enforcement Officer that the building or structure conforms with the applicable requirements of the codes. Should a remote virtual inspection not afford the Code Enforcement Officer sufficient information to make a determination, an in-person inspection shall be performed.
