The Town of Southampton has long recognized the importance of, and the value in, the humane treatment of animals. The Animal Welfare Reserve Account of the Town of Southampton is established in order to promote the safety and well-being of animals, including the safety of pets during disasters and emergencies, to implement ethical population control of feral animals by utilizing spay/neuter services, to provide access to necessary vaccinations to prevent the spread of disease, and to minimize the suffering of animals by providing necessary emergency care, feeding, and housing of animals.
The Animal Welfare Reserve Account shall be funded by the following sources, which shall not be exclusive:
A. 
Portions of revenues received in the Town of Southampton Justice Court through the collection of various fines and other court fees pursuant to § 8-6.4. An amount equal to 100% of the net revenues retained by the Town from the Animal Welfare surcharge mentioned in Town Code § 150-15B shall be used to fund budgetary appropriation(s) or by such other means as the Town Board, by resolution, deems appropriate;
B. 
Donations or contributions;
C. 
Grant monies fulfilling the purpose of this chapter from any other funding source or agency; and
D. 
Such other funds as may be legally appropriated or applied.
A. 
The Town Comptroller is hereby directed to deposit, invest, and secure the monies in said reserve account pursuant to General Municipal Law §§ 10 and 11. Any interest earned or capital gains realized on the monies so deposited shall accrue to and become part of this reserve account. No expenditure shall be made from said reserve account except pursuant to a duly adopted Town Board resolution. Additionally, the Town Comptroller shall provide an annual report to the Town Board at a work session to inform on the balance of reserve account and total disbursements.
B. 
Monies from said reserve account shall be used, at the discretion of the Town Board and in consultation with the Town's Town Code Compliance and Emergency Management Administrator, in conformance with priority recommendations of applicable Town studies and plans, for purposes including but not limited to the following:
(1) 
In connection with rendering necessary emergency veterinary aid to sick and injured animals encountered by the Department of Animal Control;
(2) 
In connection with spay/neuter programs for feral colonies of domesticated animals;
(3) 
In connection with emergency housing and permanent rehoming (including feeding and providing care) of animals that are not able to be housed by the animal shelter, including but not limited to exotic animals, horses, cattle, reptiles, etc.;
(4) 
Training and purchase of specialized equipment for the Southampton Town Department of Animal Control;
(5) 
To fund educational programs to be offered to the public;
(6) 
Any other bona fide purposes having to do with animal welfare, as deemed appropriate via Town Board resolution;
(7) 
Notwithstanding the foregoing provisions of this section, monies in the Animal Welfare Reserve Account may be appropriated during the Town’s budget process.
