For the purpose of this article, the terms used herein are defined as follows:
PERSON
An individual who has control of a dog(s), owns the dog(s) or the parent or guardian of a child less than 16 years of age who has control of the dog(s) at the time of the incident.
Any person who allows a dog(s) to defecate on private or public property other than that of the dog(s) owner's shall immediately remove same and properly dispose of same by removing it to the property of the dog(s) owner or by placing it in a proper receptacle. Failure to do so shall result in a violation of this article.
The party offended will sign an information (form) charging the offending person.
Any person violating any provision of the article shall, upon conviction thereof, be punishable by a maximum fine of $250 or by imprisonment for not more than 15 days, or both, on the first offense. On a subsequent offense, the person shall be fined a minimum of $50 and not more than $500, or by imprisonment of not more than 15 days, or both.
