This chapter shall be known and may be cited as "The New Garden Township Subdivision and Land Development Ordinance of 1991, as amended."
This chapter is designed in accordance with and enacted through the authority provided by Article V of the Pennsylvania Municipalities Planning Code, Act 247,[1] as amended, for the following purposes:
A. 
To provide systematic and uniform guidelines for the submittal, review and disposition of subdivision and land development plans.
B. 
To ensure that land development in the Township shall conform to the provisions of all New Garden Township policy and regulation, including but not limited to:
(1) 
The New Garden Township Zoning Ordinance,[2] as amended from time to time;

(3) 
The New Garden Township Official Map;
(4) 
The objectives of the New Garden Comprehensive Plan (2005);

The objectives of the New Garden Open Space, Recreation, and Environmental Resource Plan (1993); and

(6) 
The objectives of the New Garden Greenways Plan and Phelps Property Plan (2009).

C. 
To ensure coordination and conformance of subdivision and land development plans with improvements plans of the Township concerning traffic circulation and community services.
D. 
To ensure that the development of land will be conducted with due regard to natural features and ecosystems, so that the natural resources of the Township are conserved and maintained for the benefit of the residents.

The provisions of this chapter shall be held to be minimum requirements to meet the above stated purposes. Where the provisions of this chapter impose greater restrictions than those of any statute, other ordinances or regulation, the provisions of this chapter shall prevail. Where the provisions of any statute, other ordinance or regulation impose greater restrictions than those of this chapter, the provisions of such statute, ordinance, or regulation shall prevail.
