The Board of Supervisors of Upper Hanover Township hereby creates the position of Township Manager and assigns thereto the rights, duties, obligations and conditions contained in this chapter.
The Manager shall be appointed for such term as agreed upon by a majority vote of the Board of Supervisors. The Manager shall serve at the pleasure of the Board and may be removed at any time during said term by a majority vote of said Board of Supervisors.
The Manager shall be chosen on the basis of his executive and administrative abilities, with particular reference to the duties of his office as hereinafter outlined.
Before entering upon his duties and continuously thereafter, the Manager shall provide a bond to the Township with a bonding company as surety, to be approved by the Board of Supervisors, in the sum of $50,000, conditioned upon the faithful performance of his duties. The premium for said bond will be paid by the Township from the general fund.
The salary of the Township Manager shall be fixed at the time of his employment by resolution and may be adjusted from time to time by resolution passed by a majority vote of the Board.
A. 
The Manager shall be the chief administrative officer of the Township, and he shall be responsible to the Board as a whole for the proper and efficient administration of the affairs of the Township. The powers and duties of administration of all Township business shall be vested in the Manager, unless imposed or conferred by ordinance upon other Township officers.
B. 
Subject to recall by ordinance of the Board, the powers and duties of the Township Manager shall include the following:
(1) 
He shall supervise and be responsible to the Board of Supervisors for the activities of all municipal departments.
(2) 
He shall hire and, when necessary for the good of the Township, shall provide for the reprimand, discipline, suspension, removal, discharge or reduction in rank or position of any employee under his supervision.
(3) 
He shall have the power to fix wages and salaries of all personnel under his supervision, within a range previously determined by the Board.
(4) 
He shall prepare and submit to the Board, before October 31 of each year, a budget for the next fiscal year and an explanatory budget message.
(5) 
He shall be responsible for the administration of the budget after its adoption by the Board.
(6) 
He shall, in conjunction with the preparation of the yearly budget, develop long-range fiscal plans for the municipality, such plans to be presented annually to the Board for its review and adoption.
(7) 
He shall hold such other municipal offices and head such municipal departments as the Board may from time to time direct.
(8) 
He shall attend all meetings of the Board and its committees, with the right and duty to take part in the discussions.
(9) 
He shall, with the concurrence of the Chairman of the Board, prepare the agenda for any regularly scheduled meeting of the Board and supply all information pertinent to the subject matter on the agenda to each Board member at least 24 hours prior to the meeting.
(10) 
He shall keep the Board informed as to the conduct of Township affairs, submit periodic reports on the condition of the Township finances and such other reports as the Board requests and make such recommendations to the Board as he deems advisable.
(11) 
He shall submit to the Board, on or before March 31 after the close of the fiscal year, a complete report on the finances and the administrative activities of the Township for the preceding year.
(12) 
He shall see that the provisions of all franchises, leases, permits and privileges granted by the Township are observed.
(13) 
He may employ, by and with the approval of the Board, experts and consultants to perform work and to advise in connection with any of the functions of the Township.
(14) 
He shall attend to the letting of contracts in due form of law, and he shall be expected to monitor or supervise the performance and faithful execution of the same, except insofar as such duties are imposed by ordinance upon some other Township officer.
(15) 
He shall see that all money owed the Township is promptly paid and take such appropriate action as is necessary for the security and collection of the Township's claims.
(16) 
He shall be the purchasing officer of the Township, and he shall purchase, in accordance with the provisions of the Township Code, all supplies and equipment for the agencies, boards, departments and other offices of the Township. He shall keep an account of all purchases and shall, from time to time or when directed by the Board, make a full written report thereof. He shall also issue rules and regulations, subject to the approval of the Board, governing the procurement of all municipal supplies and equipment.
C. 
All complaints regarding Township services shall be referred to the office of the Manager. He shall provide for the investigation and disposal of such complaints in accordance with established policy, rules and regulations of the Board, and the Manager shall report thereon to the Board.
Neither the Board nor its members shall dictate or attempt to dictate the hiring of any person to, or his discharge from, municipal employment by the Manager or in any manner take part in the hiring, reprimanding, disciplining, suspending or discharging of employees of the Township. Further, the Board or any of its members shall make all requests, inquiries and suggestions and give orders through the office of the Manager.
If the Manager becomes ill or needs to be absent from the Township he shall designate one qualified member of his staff to perform during his absence or disability. The person so designated shall perform these duties until the next meeting held by the Board of Supervisors, at which time the Board of Supervisors shall appoint or ratify an Acting Township Manager.
