The purpose of this chapter is to establish a Conservation and Rehabilitation District. Within this District, certain actions will be taken to protect the health, safety and general welfare of the public through the issuance of certificates of compliance with current building regulations for existing residential buildings upon a change in rental tenancies.
The authority for this chapter is pursuant to § 36-105, Code of Virginia.
The Building Official shall administer and enforce this chapter, complying with the Virginia Uniform Statewide Building Code, Volume II (known as the "Building Maintenance Code"), and using HUD Section 8 Existing Housing Program Inspection Checklist.
This chapter applies to every individual, partnership or corporation that rents residential rental properties located within this Conservation and Rehabilitation District.
Application for a certificate of compliance shall be made to the Building Official, an inspection shall be performed by the Building Official within a reasonable time period, and a certificate of compliance shall be issued prior to residential property located within the Conservation and Rehabilitation District being rented.
The physical boundary of the Conservation and Rehabilitation District is congruent to the boundary of the Downtown Service District created by Galax City Council on April 13, 1987, and is described thusly:
Beginning at the NE intersection of Webster Street and Madison Street, and proceeding south with Madison Street to Center Street; thence right onto Center Street, proceeding west to the alley behind the Municipal Building (123 North Main Street); thence left onto said alley and proceeding south to Grayson Street; thence left onto Grayson Street and proceeding east to Carroll Street; thence right onto Carroll Street and proceeding south to Bartlett Street; thence right onto Bartlett Street and proceeding west to a point on Bartlett Street 155 feet east of the east side of Main Street; thence left and proceeding south from Bartlett Street, parallel with Main Street, for a distance of 657.5 feet; thence right and proceeding west 155 feet to Main Street; thence proceeding west with Academy Drive to Calhoun Street; thence left onto Calhoun Street and proceeding west to Monroe Street; thence right onto Monroe Street and proceeding north to Webster Street, thence right onto Webster Street and proceeding to its intersection with Madison Street, being the original place of beginning.
The fees for the inspection and any subsequent inspections are listed in the City of Galax Building and Tradesmen Certification Fee Schedule.
A violation of this chapter shall be deemed a misdemeanor and upon conviction shall be subject to a fine not exceeding $1,000 or 30 days imprisonment for each violation, or both.
