This chapter shall be known as the "Bingo Games and Raffle Ordinance of Carroll County, Virginia."
It shall be unlawful for any person to conduct, promote, set up or be concerned in managing a bingo game or raffle within Carroll County except as follows:
A. 
A volunteer fire department or rescue squad which has been recognized by an ordinance or resolution of the County of Carroll as being a part of the safety program of the County of Carroll.[1]

B. 
An organization which, for the purpose of this section, shall be defined as any of the following, which operates without profit and which has been in existence continuously for a period of two years immediately prior to seeking a permit as hereinafter provided:
(1) 
A corporation, trust, church, association, community chest, fund or function organized and operated exclusively for religious, charitable, scientific, literary, community or educational purposes.
(2) 
Posts or associations of war veterans or auxiliary units, or societies of any such posts or associations, if such posts, associations, units or societies are organized in the United States or any of its possessions.
(3) 
A fraternal society, order or association operating under the lodge system.
(4) 
A corporation or association organized and operated exclusively for the restoration and maintenance of historic gardens and the general promotion of beautiful gardens.
No part of the gross receipts derived from the acts regulated by this chapter shall inure directly or indirectly to the benefit of any private shareholder, member, agent or employee of any such volunteer fire department, rescue squad or organization, and provided, further, that any such volunteer fire department, rescue squad or organization shall not enter into a contract with any person or firm, association, organization, partnership or corporation managing or conducting bingo games or raffles. Such volunteer fire department, rescue squad or organization may delegate the authority or duty of organizing, managing or conducting bingo games or raffles only to a natural person or persons who are bona fide members of such volunteer fire department, rescue squad or organization.
A. 
No such organization as set forth in § 60-2 shall conduct any bingo game or raffle without first having obtained an annual permit from the County Administrator.
B. 
To aid and defray the costs of administering and enforcing the provisions of this chapter, there shall be a fee paid to the Treasurer of Carroll County upon issuance of each bingo and raffle permit as follows:

(1) 
Bingo:
(a) 
Ten dollars per day for each day bingo is conducted.
(b) 
Fifty dollars maximum shall be for the entire year for bingo that is conducted on a regular basis.
(2) 
Raffle: $5 per year.
C. 
Permits shall become valid only when signed by the County Administrator and the Treasurer of Carroll County.
D. 
While games are in progress, the permit to operate shall be on the premises where the games are being held.
The application shall be duplicated, with one copy going to the Sheriff's Department and one being retained by the County Administrator.

The Commonwealth's Attorney, County Administrator or Sheriff may revoke the permit of any organization found not to be in compliance with this chapter or not in compliance with any provision of the Code of Virginia.
A. 
Any person, shareholder, agent, member or employee of any such organization enumerated in § 60-2 found violating this chapter shall be guilty of a misdemeanor.[1]

B. 
Should any such organization enumerated in § 60-2 be found in violation of this chapter, the commomwealth's Attorney may, in addition to the foregoing criminal penalty, apply to the Circuit Court of Carroll County for an injunction against such organization from continuing to run bingo games or raffles for a period of not to exceed three years from the date of violation.
