A. 
Residential subdivisions between two and seven lots shall be required to make a cash contribution of $4,375 for each lot created.
B. 
Residential subdivisions of eight lots or more shall be required to construct one of every eight housing lots/units as an affordable unit.
C. 
Residential subdivisions of nine to 11 lots/units shall be required to comply with § 100-9A, plus a cash contribution of $4,375 for each lot created over eight and up to 11.
D. 
Residential subdivisions of 12 to 16 lots shall be required to construct two units of the 12 to 16 as affordable housing units.
E. 
Residential subdivisions of 16 lots or more shall follow the pattern established in § 100-9B and C.
For commercial or industrial developments, the following chart contains the requirements for constructing affordable housing units by such developers. In the event that the proposed development contains less than the minimum square footage needed to create one affordable housing unit, a cash contribution of $4,375 shall be made by the developer. To the extent that the proposed square footage for the development is in excess of the square footage contained in the chart below, the developer shall be responsible for providing the number of units specified by the chart plus a contribution of $4,375 for each fractional interest.

All affordable units shall contain a thirty-year deed restriction as required by COAH.
Affordable units: 50% of the units shall be low-income and 50% moderate-income.
Bedroom mix shall be in accordance with current COAH rules.
The affordable housing structures shall be consistent in size and architectural features with the neighborhood or as approved by the Land Use Board.
In the event that an applicant seeks an extension of an approval that is to expire, such extension shall be considered in accordance with the provisions of this article. Any such extension, if so granted, shall be conditioned upon the developer complying with the provisions of this article.
