This article shall be known as the "Zoning Board of Appeals Ad Hoc Members Law of the Village of Airmont."
This article is enacted pursuant to Village Law § 7-712, Subdivision 11.

In order to permit the Zoning Board of Appeals to transact business in the event that absence or conflicts of interest preclude a full membership of five members from considering a particular matter, it is deemed advantageous by the Village Board of the Village of Airmont to enact a local law to provide for the appointment of ad hoc members to the Zoning Board of Appeals.

A. 
The Village Board of the Village of Airmont shall appoint two temporary ad hoc members to the Zoning Board of Appeals to serve as provided in this chapter. The Chairman of the Zoning Board of Appeals shall assign the ad hoc members as necessary when absence of regular members of the Board or a conflict of interest of regular members of the Board would otherwise prevent five members of the Board from considering any pending matter. The ad hoc members shall be designated on a rotating basis so that each ad hoc member shall be afforded an equal opportunity to serve. Once designated to serve on a particular matter before the Board, the ad hoc member shall have the same powers and duties as regular members of the Board until that matter is concluded. Any determination by the Board consisting of ad hoc members shall have the same weight and be entitled to the same authority as the act or deed of the regular Zoning Board of Appeals, and all laws, statutes and regulation shall apply and be applied with equal force and effect. Temporary members appointed pursuant to this section shall be paid for their respective services as fixed by resolution of the Village Board.
B. 
Both ad hoc members shall serve for a term expiring at the end of the official year during which they are appointed, and their successors shall be appointed for a term of one year after the expiration of the terms of their predecessors in office. If a vacancy shall occur otherwise than by expiration of term, it shall be filled by the Board for the unexpired term. The Village Board shall have the power to remove any ad hoc member of the Zoning Board of Appeals for cause and after a public hearing.

Both ad hoc members of the Zoning Board of Appeals shall attend all meetings of the Zoning Board of Appeals but shall have no power to participate in any actions of the Zoning Board of Appeals except as provided herein.
