[HISTORY: Adopted by the Board of Trustees of the Village of Babylon as Ch. IX of the 1938 Code of Ordinances (Ch. 109 of the 1981 Code). Amendments noted where applicable.]
GENERAL REFERENCES

Solid waste — See Ch. 302.
No person shall use any land within the Village of Babylon for the purpose of a public dump or public dumping ground.
No person shall use as a dump any land, whether belonging to him or to another, nor leave thereon any unsanitary, dangerous or unsightly debris of any kind, except as herein provided.
A. 
Any person conducting the regular business of removing garbage and/or waste may use any land owned by him, or any land the owner of which shall have consented thereto in writing, as a private dump, solely for the purpose of dumping thereon the waste and/or refuse collected by him in the regular course of business; however, before so doing, he first shall obtain a written license therefor from the Board of Trustees, but said Board may issue such license upon such terms and conditions as it deems fit.
B. 
The fee for such license shall be as set from time to time by resolution of the Board of Trustees.[1]

A. 
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
B. 
In addition or as an alternative to the above-provided penalties, the Board of Trustees may also maintain an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this chapter.
