Editor's Note: The preamble to this resolution reads as follows: “WHEREAS, the Town Board of the Town of Rosendale has heretofore established a Town Planning Board pursuant to Article 16 of the Town Law, setting forth the duties of such Planning Board, and the procedures to be followed by it, pursuant to said Article, and WHEREAS, the Town Planning Board has been empowered by the Town Beard of the Town of Rosendale to approve, modify and disapprove plats for subdivision within the Town of Rosendale, and to enact and effect the rules and regulations necessary thereto, pursuant to the Land Subdivision Regulations of the Town of Rosendale, and WHEREAS, Article I provides that the Town Board, by resolution, may authorize and empower the Planning Board to add or amend subdivision regulations. Now therefore be it resolved that ...”
The Town Board of the Town of Rosendale hereby authorizes and empowers the Planning Board of the Town of Rosendale to adopt the additional procedure for land subdivision and approval of plats, as follows, subject to a public hearing to be held by the Planning Board as to such additional procedure and, further, subject to subsequent final approval thereof by the Town Board of the Town of Rosendale, after the public hearing shall have been held.
The Planning Board of the Town of Rosendale does hereby require that all proposed subdividers of property within the Town of Rosendale shall submit with the preliminary layout, pursuant to Article IV, § 60-10, of the "Land Subdivision Regulations of the Town of Rosendale, New York,"[1]  an environmental impact statement, defining in detailed analysis the environmental effect upon the real property sought to be subdivided or any portion thereof, in accordance with the guidelines established by the Town of Rosendale Planning Board, pursuant to the laws of the State of New York.

The foregoing statement shall be submitted to and approved by the Planning Board prior to granting approval of land subdivision or issuance of permits therefor.
Said statement shall be required only for proposed subdivisions of more than four lots or for the development of a business or industrial site which shall employ more than nine people or for any subdivision of the land for purposes of erecting thereon one or more apartment houses. An apartment house is that which contains more than two separate apartments.
The environmental impact statement criteria, as has or shall be promulgated by the Department of Environmental Conservation in accordance with its codes, rules and regulations, shall be filed with the Planning Board of the Town of Rosendale and shall be made available for public inspection at the Town Clerk's office of the Town of Rosendale during the business hours of any weekday.
