It shall be unlawful and a violation of this chapter for any minor under 18 years of age to be or remain upon any street, alley or public place within the Village of Round Lake after 10:00 p.m. on any Sunday, Monday, Tuesday, Wednesday or Thursday evening, and before 5:30 a.m. on any Monday, Tuesday, Wednesday, Thursday or Friday morning, unless such minor is accompanied by his or her parent or guardian or a person over the age of 21 years who is authorized, by written authorization, by such parent or guardian to accompany such minor at such time and place.
It shall be unlawful and a violation of this chapter for any minor under 18 years of age to be or remain upon any street, alley or public place within the Village of Round Lake after 10:00 p.m. or before 5:30 a.m. on any Saturday or Sunday morning, unless such minor is accompanied by his or her parent or guardian or a person over the age of 21 years who is authorized, by written authorization, by such parent or guardian to accompany such minor at such time and place.
It shall be unlawful and a violation of this chapter or any parent, guardian or person having the legal care and custody of any minor under 18 years of age to allow or permit any such minor under the age of 18 years and while in his or her legal custody to go, be or remain in or upon any street, alley or public place within the Village of Round Lake after the time set forth in §§ 104-1 and/or 104-2 of this chapter.
Any peace officer or enforcement officer, as defined in Chapter 6, Appearance Tickets, of the Code of the Village of Round Lake, is hereby authorized to detain any minor violating the provisions of this chapter until the parent or guardian of such minor shall take him or her into custody; but such officer shall immediately, upon taking custody of a minor, communicate with the parent or guardian of such minor unless it shall reasonably appear, upon due inquiry, that no parent or guardian of such minor is available to assert custody, in which latter case said minor shall be turned over to the custody of the Family Court of the County of Saratoga.
The Board of Trustees of the Village of Round Lake shall have the power to grant extensions of this curfew to children under the age of 18 years to be in or upon the streets, alleys or public places within the Village of Round Lake at times different than as designated herein in order to attend such functions as the Board of Trustees may have authorized. Appropriate passes will be issued to children granted such extensions. Such passes shall be given by the Board of Trustees to the sponsor of any such function, who shall issue them at the function and not before. The pass shall state the name of the function, the sponsor and the date and the time to which the curfew is extended. The Board of Trustees shall also have the authority to exempt from the provisions of this chapter persons whose employment requires them to be in or upon the streets, alleys or public places within the Village of Round Lake after the hours designated herein. Such persons may be issued an exemption identification card by the Board of Trustees. Applications therefor shall be made to the Village Clerk. Each exemption identification card shall indicate the name of the person to whom the card is issued, the name of the person's employer and the hour to which the curfew is extended.
Any person who shall violate any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be subject to a fine of not more than $100 for the first offense and $250 for each offense thereafter.
A. 
The Board of Trustees of the Village of Round Lake may, by resolution, lower or raise the age of the minors to which this chapter applies, except that in no event may the age of persons to whom this chapter applies exceed 18 years of age.
B. 
The Board of Trustees of the Village of Round Lake may, by resolution, change the hours (as set forth in §§ 104-1 and 104-2 above) to which this chapter applies.
C. 
The Board of Trustees of the Village of Round Lake may, by resolution, suspend the application of the within chapter in its entirety and, by further resolution, reinstate the application of the within chapter.
