No person shall install, maintain, operate or possess in any store, building or other place within the Borough where the public is invited or where the public may enter any bagatelle, pinball, shooting ray gun, music and all other amusement or entertainment machines in which coins are inserted or for which coins are received or accepted for operation of such games without having first obtained a license therefor as required by this chapter.
A. 
The proprietor of the premises where a machine subject to the provisions of this chapter is to be installed shall, before such installation, make a written application for a license for each machine to be installed on the premises on such forms as the Borough Clerk shall prescribe.
B. 
Such application shall state the following:
(1) 
The name, residence and address of the proprietor and the business location where the machine is to be installed.
(2) 
The number and type of machines to be kept.
(3) 
The name and address of the person owning the machine.
(4) 
The serial number and description of the machine to be licensed.
A. 
The application for a license required by this chapter shall be accompanied by a license fee as provided in Chapter A263, Fees, for each machine to be licensed.

B. 
The license fee for any license issued in any calendar year after the first day of July shall be 1/2 the yearly fee.
Licenses issued in accordance with the provisions of this chapter shall expire on the last day of December of each year and shall be renewed annually on or before the last day of December by filing a written application for renewal with the Borough Clerk. The application for renewal shall contain the same information required in § 95-2 for an original application.
Each license issued in accordance with the provisions of this chapter shall contain the serial number and description of the machine licensed, and such license shall be firmly attached in a conspicuous place on the machine so that it shall be easily and quickly readable and the machine identified, and no such device or machine shall be placed, operated, maintained or used in the premises until the requirements of this section have been complied with.
No licensee shall offer any prize or other reward to any person playing any machine subject to the regulations of this chapter nor shall any licensee permit any such machine to be used for gambling purposes, and no free plays or prizes or return of any money shall be allowed.[1]

Premises wherein the operation of amusement machines as defined in § 103 of the Land Development Ordinance of the Borough of Rockaway, New Jersey, is permitted as either a principal or an accessory use as set forth in said Land Development Ordinance of the Borough of Rockaway, New Jersey,[1] shall be subject to the licensing and regulation provisions of this chapter.
