The purpose of this chapter is to regulate the stopping, standing or parking of any vehicle at any time in any area hereinafter established by the Town Board of the Town of Colonie or its designee as a fire lane in order to prevent the obstruction or interference with the ingress and egress of emergency vehicles for the protection of persons and property pursuant to § 1660-a of the Vehicle and Traffic Law of the State of New York.
As used in this chapter, the following terms shall have the meanings indicated:
AUTHORIZED EMERGENCY VEHICLE
Every ambulance, police vehicle, fire vehicle, civil defense emergency vehicle, emergency ambulance service vehicle and ordnance disposal vehicle of the Armed Forces of the United States.

COMMERCIAL VEHICLE
Any vehicle engaged in the delivery and/or loading of merchandise, supplies or other material or the rendering of services to stores or business establishments.
EMERGENCY OPERATION
The operation or parking of an authorized emergency vehicle, when such vehicle is engaged in transporting a sick or injured person, pursuing an actual or suspected violator of the law or responding to or working or assisting at the scene of an accident, authorized emergency training exercise, disaster, police call, alarm or fire or other emergency. "Emergency operation" shall not include returning from such service.
FIRE LANE
Any zone or area established as such pursuant to this chapter.
PARKING
The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
RESIDENT
A person who resides in the Town of Colonie or pays real property taxes to the Town of Colonie.
STANDING
The stopping of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in receiving or discharging passengers.
STOPPING
When prohibited, any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal.
TOWN
The Town of Colonie, situated in Albany County in the State of New York.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
This chapter applies only to fire lanes established by the Town Board or its designee pursuant to this chapter or any amendment thereto.
The stopping, standing or parking of any vehicle in any area established by the Town Board of the Town of Colonie or its designee and marked "Fire Lane" within the geographical limits of the Town of Colonie is hereby prohibited unless herein and hereafter expressly permitted.
The prohibitions contained in § 97-4 hereof shall not apply to:
A. 
Commercial vehicles parked at loading docks or service entrances to stores or business establishments while said commercial vehicles are actively engaged in the delivery and/or loading of merchandise, supplies or other material or the rendering of services to such stores or business establishments.
B. 
Authorized emergency vehicles engaged in emergency operations within the particular location of the fire lane.
C. 
All public transit buses, such as CDTA buses, or any other services to persons or property within the particular location of the fire lane.
A. 
The Town Board or its designee shall designate any areas at, on or near any interior street, roadway, driveway or parking area in which any obstruction due to the parking or placing therein of any vehicle or any other physical object will cause interference with the ingress and egress of fire-fighting equipment or authorized emergency vehicles or which will create a condition dangerous to life or property in the event of fire.
B. 
The designated areas shall thereupon be marked with standard signs and/or such other markings and signs which conform to accepted sign standards as set forth in the New York State Manual of Uniform Traffic Control Devices and which are deemed necessary and proper by the Town Board or its designee.
C. 
Signs and markings shall be installed by and at the expense of the owner of the property within 120 calendar days after receipt of official written notice by the Town Board or its designee designating and depicting areas and locations of such signs and markings. Thereafter, all such signs and markings shall be maintained by and at the expense of the owner of the property.

D. 
In the event that any owner refuses or fails to install any and all required signs and markings within 120 calendar days of receiving said official notice, and refuses or fails to maintain all such required signs and markings thereafter, the Town shall promptly perform the required work, and the Town Board or its designee may provide for the assessment of all costs and expenses so incurred by the Town in connection with any such action taken to become a lien against the land on which such signs and markings are located.

A. 
A Fire Lane Appeals Board shall be and it hereby is established.
B. 
The purpose of this Board is to provide for a process by which designations of fire lanes by the Town Board or its designee pursuant to this chapter and/or any rule or regulation promulgated pursuant thereto may be appealed.
C. 
Membership shall consist of from three to five residents of the Town of Colonie, appointed by the Supervisor with approval of the Town Board. Members shall serve terms of one year and, thereafter, may be appointed on an annual basis. Members shall serve without pay, and vacancies shall be filled for an unexpired term in the same manner as the original appointment.
D. 
Members of the Fire Lane Appeals Board shall meet and elect one of their members as Chairman and shall meet thereafter as needed and shall adopt rules and regulations for conducting the business of the Board, which shall be filed with the Town Clerk.
Notwithstanding the provisions of § 97-9B:
A. 
Any person, persons, firm, association, partnership or corporation violating the provisions of § 97-4 of this chapter shall be guilty of a traffic infraction and shall, upon conviction thereof, be subject to a fine not exceeding $250 or imprisonment not exceeding 15 days, or both.
B. 
Any conviction for the violation of § 97-4 of this chapter shall additionally subject such violator to such penalties as are provided by § 401, Subdivision 5a, of the Vehicle and Traffic Law of the State of New York and such further penalties as may be provided by the Vehicle and Traffic Law of the State of New York.
C. 
Notwithstanding the provisions of Subsections A and B, any person, persons, firm, association, partnership or corporation violating the provisions of § 97-4 of this chapter shall be guilty of a violation and, upon conviction thereof, shall be subject to a civil penalty not to exceed $250, to be recovered in an action or proceeding in a court of competent jurisdiction. For each day in which a violation of § 97-4 of this chapter remains, it shall be considered a separate offense.
D. 
The Town Attorney may maintain an action or proceeding in a court of competent jurisdiction to compel compliance with any provision of this chapter or any rule or regulation promulgated pursuant thereto.
A. 
The enforcement of this chapter and rules and regulations promulgated pursuant thereto will be by the Police Department of the Town, by the Fire Prevention Bureau of the Town and by such special persons as may be, from time to time, authorized by the Town Board of the Town of Colonie.
B. 
Any vehicle stopped, standing or parked in a fire lane may be removed therefrom and stored at the direction of the Town of Colonie Police Department and/or the Department of Fire Prevention.[1] The owner or operator of such vehicle shall be liable to the Town of Colonie or its designee for the payment of reasonable charges for such removal and storage of any such vehicle.

A. 
195 Troy Schenectady Road, the following four courses:

An area 35 feet, plus or minus, wide from the southeast corner of the building for a distance of 518 feet, plus or minus, in a westerly direction.
(2) 
An area 55 feet, plus or minus, wide, starting at a point 88 feet, plus or minus, in a northerly direction from the southeast corner of the building for a distance of 84 feet, plus or minus, in a northerly direction.
(3) 
An area 40 feet, plus or minus, wide, starting at a point 137 feet, plus or minus, in an easterly direction from northwest corner of the building for a distance of 137 feet, plus or minus, in an easterly direction.
(4) 
An area 55 feet, plus or minus, wide from the northwest corner of the building for a distance of 270 feet, plus or minus, in a southerly direction.
B. 
420-424 Sand Creek Road (presently known as the "Towers of Colonie Center Apartments, Inc."), the following seven courses:

The roadway 30 feet, plus or minus, wide, which is the northwest entrance to the Towers of Colonie from Sand Creek Road (hereinafter to be known as the "main entrance"), extending for a distance of 0.3, plus or minus, of a mile in a southerly and southwesterly direction; to be included is the entire length of the roadways, 20 feet, plus or minus, wide, which intersect the main entrance and pass directly in front of each of the apartment buildings (420, 422 and 424 Sand Creek Road).
(2) 
An area 20 feet, plus or minus, wide from the northwest curb, starting from the southeast entrance from Sand Creek Road and extending for a distance of 170 feet, plus or minus, in a southwesterly direction.
(3) 
An area 14 feet, plus or minus, wide, running in a northeasterly direction from Building 1 (420 Sand Creek Road) to Sand Creek Road for a distance of 179 feet, plus or minus.
(4) 
An area 15 feet, plus or minus, wide, running in a westerly direction from Building 2 (422 Sand Creek Road) for a distance of 250 feet, plus or minus.
(5) 
An area 14 feet, plus or minus, wide, running in an easterly direction from Building 3 (424 Sand Creek Road) for a distance of 130 feet, plus or minus.
(6) 
In the general area of the south end of Building 3 (424 Sand Creek Road), an area 24 feet, plus or minus, wide, a point that begins 1,065 feet, plus or minus, from Sand Creek Road along the northeast roadway and extends for a distance of 240 feet, plus or minus, around perimeter of curbing.
