This chapter shall be enforced by the Code Enforcement Officer who shall in no case except under a written order of the Board of Appeals grant any building permit or certificate of occupancy for any building or premises where the proposed construction, extension or use thereof would be in violation of any provisions of this chapter.
No building in any zoning district shall be begun, extended or carried on without a building permit issued by the Code Enforcement Officer.
A. 
Every application for a building permit shall state the intended use of the building and shall be accompanied by a sketch plan drawn to scale and with all dimensions shown indicating the size and shape of the lot and the location of all buildings. The sketch shall indicate lots and buildings on lots immediately adjacent.
B. 
Such permit shall be conspicuously displayed on or near the building or buildings during the entire course of construction.
C. 
Unless there has been substantial progress in the work for which a building permit was issued, said permit shall expire one year from the date of issuance.
D. 
A fee shall be charged for every permit issued according to the schedule adopted by the Town Board whether as an amendment to this chapter or otherwise.
E. 
All building permits previously issued shall expire 30 days after this chapter becomes effective unless construction has commenced to a point where footings are completed.
F. 
Any permit issued shall be void if construction, alteration or extension does not comply with plot plan submitted and approved.
G. 
The Town Board shall have the power to withhold building permits in any area where water, sewer or soil conditions are deemed to be a health hazard.
Each property owner shall be responsible for compliance with all terms of this chapter affecting his or her property. Upon application, the Code Enforcement Officer shall issue a certificate of occupancy when he or she is satisfied that the proposed use complies with this chapter and that buildings have been constructed and the site developed in accordance with submitted plans. No property shall be occupied or used until said certificate of occupancy has been issued.
No building permit or certificate of occupancy issued under the terms of this chapter shall become or remain valid unless the holder thereof complies with the requirements of the New York State and Chemung County Health Department.
A. 
A violation of this chapter is hereby declared to be an offense punishable by a fine not to exceed $350 or imprisonment for a period not to exceed six months, or both, for a conviction of a first offense; for a conviction of a second offense, both of which were committed within a period of five years, punishable by a fine of not less than $350 nor more than $700 or imprisonment for a period not to exceed six months, or both; and upon conviction of a third or subsequent offense, all of which were committed within a period of five years, punishable by a fine of not less than $700 nor more than $1,000 or imprisonment for a period not to exceed six months, or both. Each week's continued violation shall constitute a separate additional violation.

B. 
In case any building or structure is erected, constructed, reconstructed, altered, converted or maintained or any building, structure or land is used or any land is divided into lots, blocks or sites in violation of the provisions of this chapter, the Town Board or Code Enforcement Officer of the Town, in addition to other remedies as provided for by law, may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, conversion, maintenance, use or division of land to restrain, correct or abate such violation, to prevent the occupancy of said building, structure or land or to prevent any illegal act, conduct, business or use in or about such premises; and upon the failure or refusal of the Town to institute any such appropriate action or proceeding for a period of 10 days after written request by a resident taxpayer of the Town so to proceed, any three taxpayers of the Town residing in the district wherein such violation occurred may institute such appropriate action or proceeding in the manner as the Town is authorized to do.
