The Hanover Township Volunteer Fire Company #1 (the "Fire Company"), organized and existing in the Township of Hanover, Northampton County, Pennsylvania, is hereby designated as the officially recognized Fire Company for the Township of Hanover, Northampton County, Pennsylvania (the "Township"). The Township shall consult with the Fire Company to discuss the emergency services needs of the Township.
A. 
The Fire Company recognized by the Township is hereby authorized to provide such services to the Township as may be necessary for the protection of property and persons situate therein, which shall include, by way of example and not of limitation, the extinguishment and prevention of loss of life and property from fire, automobile accidents, medical emergencies, hazardous materials incidents, and other dangerous situations.
B. 
The Fire Company may also provide nonemergency and public service functions, such as, again by way of example and not of limitation, removing water from property after storms, and assisting in the removal, abatement and prevention of damage or injury to persons or property, whether through natural causes or man-made situations.
C. 
The Fire Company may also conduct and participate in such training activities and drills, either within or outside of the Township, as may be deemed necessary by the officers of the Fire Company to maintain proficiency in providing service.
D. 
The Fire Company may also respond to calls and provide services to municipalities outside of the Township.
E. 
The Fire Company may participate in social events outside the Township upon the approval of the Chairman of the Township's Board of Supervisors or his designee.
F. 
The Fire Company shall provide to the Township an annual itemized listing of all expenditures of funds received from the Township before the Township may consider budgeting additional funding for the Fire Company.
In addition to actually participating in the activities of the Fire Company as authorized above, or in going to or returning from any activity, the members of the Fire Company recognized by the Township are also authorized to do the following things:
A. 
Engage in any type of drill, training, ceremony, practice, test or parade when duly called for or authorized by an officer or officers of the Fire Company.
B. 
Engage in fund-raising activities for the Fire Company, when authorized by an officer or officers of the Fire Company.
C. 
Engage in the performance of any other duty or activity authorized by any officer of the recognized Fire Company.
D. 
Engage in the performance of duties as the Township's special fire police after being confirmed by the Chairman of the Township's Board of Supervisors. When so confirmed, sworn and displaying a badge of authority, they shall have full power to regulate traffic and keep crowds under control at or in the vicinity of any fire on which their companies are in attendance and to exercise such other police powers as are necessary in order to facilitate and prevent interference with the work of firemen in extinguishing fires and, in addition, shall have the police powers necessary to perform their duties when functioning as special fire police at any function, event, or parade conducted by, and under the auspices of, the Fire Company, or any other event, function, or parade conducted by an organization other than the Fire Company, providing the request to perform these duties is made by the Township, or when accidents, floods or any other emergencies require performance of such traffic control and crowd control duties. Such duties may be performed without prior request from the Township or Colonial Regional Police Department, and thereafter subject to direction of such police authority until the emergency no longer exists. A person functioning as special fire police, and performing a duty under any of the above conditions, shall be deemed to be performing the duties of his employment. Fire police performing such duties shall be identifiable by, at minimum, the wearing of a distinctive ANSI-approved public safety vest, hat, uniform or insignia. Under no circumstances shall this chapter be construed to grant special fire police the right and/or power to use firearms or other weapons in the exercise of special fire police powers granted hereunder.
The purpose of this chapter is to recognize the Fire Company as the official Fire Company of the Township, and to state additional authorized activities for fire fighters and special fire police for workmens' compensation.
