[HISTORY: Adopted by the Council of Latrobe 7-13-1981 by Ord. No. 1981-2 as Ch. XIII, Part 5, of the 1981 Code. Amendments noted where applicable.]
A. 
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Any natural person, firm, corporation, association, club, partnership or society or any other form of association or organization.
SOUND-AMPLIFYING EQUIPMENT
Any machine or device for the amplification of the human voice, music or other sound, but shall not be construed as including standard automobile radios when used and heard only by the occupants of the vehicle in which installed or warning devices on authorized emergency vehicles or horns or other warning devices on other vehicles used only for traffic safety purposes.
SOUND TRUCK
Any vehicle having mounted thereon or attached thereto any sound-amplifying equipment.
B. 
The singular shall include the plural, and the masculine shall include the feminine and the neuter.

No person shall use or cause to be used any sound truck or other vehicle with sound-amplifying equipment in operation in Latrobe unless such person shall first have obtained a permit therefor from the Mayor, for which no fee shall be charged.

Application for a permit to use a sound truck or other vehicle with sound-amplifying equipment shall be made to the Mayor by the person desiring to operate such vehicle or to use the services thereof and shall be made not less than 24 hours before such use is desired. Separate application shall be made and a separate permit issued for each day upon which such use is requested.

In issuing a permit under this chapter, the Mayor may specify the hours when such permit shall be valid, taking into account the time when such use of a sound truck or other vehicle with amplifying equipment would be least likely to cause annoyance to the citizens of Latrobe, and may also stipulate the route that such sound truck or other vehicle may follow or the location(s) where the sound-amplifying equipment may be in operation so as to minimize traffic congestion and/or disturbance to the public. The permittee shall strictly observe the conditions of the permit as to time and place of operation of such sound truck or other vehicle, and any divergence therefrom shall constitute a violation of this chapter.

Any person who shall violate any provision of this chapter shall, upon conviction thereof, for each and every violation be sentenced to pay a fine of not more than $600 and costs of prosecution or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days, provided that each day's violation of any provision of this chapter shall constitute a separate offense.
