A. 
Wherever a particular parking space shall be lined or marked off on any street or alley, or upon the adjacent curb, every vehicle parked shall be parked within the lines marking such parking space; and all vehicles parked on streets or alleys within Latrobe, whether parking spaces are marked or not shall be parked only in the direction of the permitted traffic flow.
B. 
Parking shall be prohibited at all times in any manner by any vehicle which in any way will block the intersection of any street with another street; at any intersection of a street with any alley so as to block the entrance or exit from any alley; at any point within the painted line area adjacent to any fire hydrant; at any point within the painted line area marking the permissible distance to park from any intersection; in any area where erected signs or painted lines indicate a "no parking" area; in any manner so as to block any public driveway or accessway to a parking lot or parking facility or other facility of Latrobe; or so as to block any private driveway within Latrobe.

A. 
Prohibited parking at all times. The Council of the City of Latrobe may, from time to time, by ordinance duly adopted and amended, prohibit upon designated streets, highways and alleys of Latrobe any and all parking at all times. Council may also, from time to time, on a trial basis by resolution duly adopted, prohibit upon designated streets, highways and alleys of Latrobe any and all parking at all times. Any resolution adopting the same on a trial basis shall be ratified and made permanent by ordinance. The locations, as adopted, shall be set forth in Schedule V (§ 256-51A).
B. 
Parking of certain commercial vehicles in residential zones prohibited. It shall be unlawful for the owner or operator of any bus, truck or any type of commercial vehicle designated as Class III or above, as defined by the Pennsylvania Motor Vehicle Code, to park such vehicle at any time on any public street or alley in a residentially zoned area situate in the City of Latrobe. Excepted from this provision shall be commercial or business vehicles and/or equipment parked in a residential zone during the normal hours of business operation for the purpose of providing delivery or service to a property in a residential area or conducting repairs or maintenance upon streets and alleys in a residential zone. Any other commercial or business vehicle of any type shall be parked or stored in an enclosed garage in a residential zone.
(1) 
Any such owner or operator who violates the provisions of this subsection shall, for the first offense, be issued a warning to be prominently displayed on the vehicle, which warning shall inform the owner/operator:
(a) 
Of the provisions of this subsection and violation thereof;
(b) 
That the owner/operator must remove the vehicle parked upon a street or alley in any residential zone on or before 12:01 a.m. on the 14th day of the date of the warning;
(c) 
That any subsequent violation of this subsection by the owner/operator of said vehicle, after the expiration of the time for removal of said vehicle from the street or alley, can result in a citation being issued against the owner/operator for which a fine or a penalty can be incurred; and
(d) 
Of the right of the owner/operator to petition Council for a variance from this subsection, which petition shall act as a supersedeas until determination by Council.
(2) 
In addition to placing a warning on the vehicle, the City shall also send a letter by ordinary and registered mail to the last-known address of the owner of the vehicle, setting forth in detail the information contained in the warning. In the event that the registered letter shall be returned unclaimed or refused and the letter sent by ordinary mail is not returned as undeliverable within 10 days of the date of mailing, then and in that event service of the letter shall be deemed to be made upon the owner.
(3) 
Any owner or operator who shall violate the provisions of this subsection shall be subject to the provisions of § 256-20, Violations and penalties, of the Code of Ordinances of the City of Latrobe.
C. 
Parking prohibited for certain periods of time. The Council of the City of Latrobe may, from time to time, by ordinance duly adopted and amended, prohibit upon designated streets, highways and alleys of Latrobe any and all parking at and for certain periods of time. Council may also, from time to time, on a trial basis by resolution duly adopted, prohibit upon designated streets, highways and alleys of Latrobe any and all parking at and for certain periods of time. Any resolution adopting the same on a trial basis shall be ratified and made permanent by ordinance. The locations, as adopted, shall be set forth in Schedule XVII (§ 256- 63A).

D. 
It shall be unlawful to park, store and/or place any container, trailer or other similar vehicle or object upon any public street or right-of-way, unless the same is duly permitted, registered and/or licensed as may be required by local, state and/or federal law or regulation, and the same is securely closed and or covered, prohibiting the public at large from accessing the contents of said container, trailer, or other similar vehicle or viewing said contents from the right-of-way.

The Council of Latrobe may, from time to time, on a trial basis, by resolution duly adopted and amended, prohibit upon designated streets, highways and alleys of Latrobe any and all parking between the hours of 2:00 a.m. and 6:00 a.m. Any resolution adopting the same on a trial basis shall be ratified annually by ordinance. The locations, as initially adopted, shall be set forth in Schedule VI (§ 256-52).
No person shall park any truck, with a gross vehicle weight in excess of 26,000 pounds, tractor, trailer or tractor-trailer combination or allow the same to remain parked on any street or alley in Latrobe for a period longer than two hours.
The Council of Latrobe may, from time to time, on a trial basis, by resolution duly adopted and amended, limit parking upon the streets, highways and alleys of Latrobe to a two-hour parking period in certain locations. Further, any resident whose home is within a two-hour parking zone may apply for a special parking permit which shall except any vehicle of the owner or his family bearing such permit from any violation for overtime parking under this section. Any resolution adopting the same on a trial basis shall be ratified annually by ordinance. The locations, as initially adopted, shall be set forth in Schedule VII (§ 256-53).
The Council of Latrobe may, from time to time, on a trial basis, by resolution duly adopted and amended, designate portions of streets, highways and alleys in Latrobe as parking by permit only areas between the hours of 7:00 a.m. and 8:00 p.m., applicable time. Any resolution adopting the same on a trial basis shall be ratified annually by ordinance. Parking of any type of motor vehicle requiring registration under the laws of the Commonwealth of Pennsylvania shall be permitted for vehicles owned and registered in the name or names of residents living in the area designated for parking by permit only under the consideration set forth below:
A. 
Parking shall be permitted to motor vehicles during those hours prescribed herein only if a permit issued by Latrobe is displayed on the vehicle.
B. 
Parking by permit only areas are hereby set forth and included in Schedule VIII (§ 256-54).
C. 
Permits for the parking of vehicles in the areas designated herein as "parking by permit only areas" shall be issued by the Chief of Police in the form approved by the Police Committee of Latrobe Council, without charge, only to residents of Latrobe who have a permanent residence in the area of the particular street herein designated as a "parking by permit only area."
D. 
The owner or operator of any motor vehicle parking in any area designated as a "parking by permit only area" during the hours designated herein without the official permit displayed in the parked vehicle in such manner so as to be visible to police officers shall be considered to have parked in violation of this section of the Code of Latrobe.
E. 
The owner of any vehicle parked in violation of the provisions of this section shall be given a ticket or citation assessing a fine for violation for parking in a prohibited zone in an amount of $30, and if the fine is not paid, the owner shall be subject to the additional penalties as set forth in § 256-20B of this chapter.[1]

The Council of Latrobe may, from time to time, on a trial basis, by resolution duly adopted and amended, designate portions of streets, highways and alleys in Latrobe as handicap or disabled veteran parking areas. Requests for this designation may be made by application to the proper officer. Any such handicapped or disabled veteran parking area shall be so marked and designated. Any resolution adopting the same on a trial basis shall be ratified annually by ordinance. Parking of any type of motor vehicle whose owner and operator shall be defined as "handicapped" or a "disabled veteran" under the provisions of the Pennsylvania Motor Vehicle Code shall be permitted in these areas.
The Police Department of Latrobe may, from time to time, designate certain on-street and/or off-street parking spaces as restricted or no parking areas on a temporary basis by the placing of a meter cover, marker or other sign identifying "no parking by order of police department." The owner of any vehicle parked in violation of the provisions of this section shall be given a traffic ticket or citation assessing a fine for violation for parking in a prohibited area designated hereunder in the amount of $15, and if the fine is not paid, the owner shall be subject to the additional penalties as set forth in § 256-20B of this chapter.
The loading and unloading of goods, wares and merchandise is hereby restricted to such length of time as is absolutely necessary for the purpose of loading and unloading of such goods, wares and merchandise. For the purpose of enforcement of this section, such loading or unloading of any vehicle shall not be considered as parking, provided, however, that without having first obtained permission from the Police Department of Latrobe to do so, no person shall load or unload a vehicle from any place upon any street or alley in Latrobe where parking is prohibited; nor shall any person allow a vehicle to remain, for loading or unloading, in any place upon any street or alley where parking is limited as to time for longer than the time for which parking is permitted; nor shall any person load or unload upon any street or alley in such a way that one lane for vehicular traffic shall not be kept open at all times; nor shall any person be permitted or authorized to stand or park any vehicle on state-designated highways except during off-peak traffic flow hours, as determined by regulations of the Department of Transportation. Where such permission is granted by the Police Department of Latrobe for non-state-designated highways, the Police Department of Latrobe, at its discretion, may block off the portion of the street or alley affected by such loading or unloading.
A. 
The owner of any vehicle parked so as to violate any provision of this article shall be issued a ticket or citation assessing a fine in accordance with the following schedule:
(1) 
Fifteen dollars for blocking an intersection, a street or an alley; parking in a prohibited zone adjacent to a fire hydrant; blocking private or public driveways or accessways.
(2) 
Fifteen dollars for parking in a prohibited zone too close to an intersection; parking on any sidewalk within Latrobe or parking in a prohibited zone designated by an erected sign or by painted lines indicating a no parking zone.
(3) 
Fifteen dollars for parking in the wrong direction on any street; over-parking in a limited parking zone not metered.
(4) 
Fifteen dollars for parking in a prohibited location as set forth in this § 256-12A and D.

(5) 
Fifteen dollars for parking in an on-street handicapped/disabled veteran parking area.
(6) 
Fifty dollars for violation of § 256-12, Prohibited parking, Subsection B regarding prohibited parking of certain commercial vehicles in residential zones.

B. 
There is hereby established a presumption that the individual who is the operator of a vehicle was so with the authority and permission of the owner, and, therefore, liability for payment of any fine or penalty shall be imputed to the owner. If any fine or penalty for parking violation is not paid to the City of Latrobe within seven days of the issuance, by either the owner or operator of the vehicle, then and in that event the owner and/or operator shall commit a summary offense. The City of Latrobe may file a citation for nonpayment, which shall be a summary offense, with the appropriate District Justice against the owner and/or operator, or both. If the owner or operator, or both, are found guilty, either, or both, shall be jointly and severely subject to the parking fine set forth above, and any additional fine for failure to pay the same and for costs of prosecution. Failure to pay any fine or cost levied by the District Justice within 10 days after conviction can result in incarceration of the owner and/or operator, or both, for a period not to exceed five days. Such fine and costs may also be collected through civil remedies as other charges or debts owing to the City of Latrobe may be collected. The District Justice may also impose such other remedial order as is within the jurisdiction of the District Justice in order to enforce the payment of fines and costs; and, the vehicle may be subject to the application of the Boot Ordinance as set forth in the Code of Ordinances for the City of Latrobe[1] for nonpayment of fines and costs.

C. 
In addition to the fines and penalties set forth above, the City of Latrobe may, for habitual offenders, seek injunctive relief for the prohibition of such conduct in the Court of Common Pleas of Westmoreland County.
