Parking facilities shall be designated as either on-street metered parking or off-street metered parking, permit parking and/or special permit parking and shall be located at those sites described and designated as follows:
A. 
On-street metered parking zones are hereby established upon and along certain of the streets, highways and alleys in Latrobe, which said zones may be altered or changed from time to time by resolution of the Council of Latrobe and are set forth herein in Schedule IX (§ 256-55).
B. 
Off-street parking facilities shall be those sites described and designated in Schedule X (§ 256-56), which sites, or a portion of said sites, shall, from time to time, be designated by the City Manager as metered parking, permit parking or special permit parking, or a combination of the above. The City Manager shall also establish the rate for each of the above sites. The City Manager shall submit a written report to the Council of the City of Latrobe and the Latrobe Parking Authority regarding the designation of off-street parking facilities and sites or any changes to designations for the same, or any rate changes for such designations within 15 days after such action by the City Manager. Council shall, within 60 days thereafter, ratify and make permanent the action of the City Manager.

C. 
The Latrobe Parking Authority may, from time to time, enter into lease agreements for property for special permit parking, which said lease shall be approved by the Council of Latrobe.

Metered parking spaces shall be identified as follows:
A. 
On-street metered parking spaces shall be located parallel to the curbing and/or sidewalk of the highways, streets and alleys within Latrobe in designated zones and shall be identified by the location of a single-meter head pole or double-meter head pole.
(1) 
Any vehicle parking in a metered space identified by a single-head pole shall be parked so that the foremost part of the front of such vehicle shall be no further than 12 inches from the parking meter, and the side of said vehicle closest to the curb shall be no further than 12 inches from said curb.
(2) 
Any vehicle parked in such a parking space identified by a double-head meter shall be parked so that it shall occupy that space closest to the double-head meter with the foremost part of the front of such vehicle no further than 12 inches from the double-head meter or the rear of said vehicle no further than 12 inches from the same, depending on which space is available for parking, with the side of such vehicle being parallel to the curb at a distance no greater than 12 inches from the same.
B. 
Certain on-street metered parking spaces may be designated, from time to time, by the Latrobe Council in such a manner that the space shall be marked off in either a perpendicular or diagonal fashion with a single-meter head pole being located upon the curb or sidewalk. In such type of on-street metered parking space, such vehicle shall be parked between the marking lines designating such space, with the foremost part of the front of said vehicle being no further than 12 inches from the curb or sidewalk.
C. 
Off-street parking facilities. Parking spaces shall be marked off in the off-street parking facilities. Said parking spaces shall be either perpendicular to the parking meter or diagonal to the parking meter. Single-pole meters shall be located at the center of said space, and any vehicle parked at such space shall be parked wholly between the lines designating the same with the foremost part of the front of said vehicle being at no greater distance than 12 inches from the parking meter.
D. 
Permit parking and/or special permit parking spaces shall be identified as follows:
(1) 
All or a portion of any off-street metered parking facility may be designated as permit parking or special permit parking, or a combination thereof, by action of the City Manager. The City Manager shall also establish the rate for each of the above sites. The City Manager shall submit a written report to the Council of the City of Latrobe and the Latrobe Parking Authority regarding the designation of off-street parking facilities and sites or any changes to designations for the same, or any rate changes for such designations within 15 days after such action by the City Manager. Council shall, within 60 days thereafter, ratify and make permanent the action of the City Manager. Said changes shall be marked as set forth in Subsection C above.

(2) 
Each such permit parking or special permit parking facility, or portion thereof, shall be appropriately signed as permit parking or special permit parking only.
(3) 
Facilities designated for permit parking and/or special permit parking may be owned or leased by the City of Latrobe or the Latrobe Parking Authority.
E. 
Council may, from time to time, by resolution to be ratified by ordinance, designate unmetered parking spaces on public streets which shall be marked off either in perpendicular or diagonal fashion. Any vehicle parking in such space shall be parked between the marked lines designating such space, with the side or front of said vehicle (depending on the type of parking space) being no further than 12 inches from the curb or sidewalk. Any such vehicle or person violating this section shall be subject to the same provisions for fines and penalties as though the space were a metered parking space.

F. 
Council may, from time to time, by resolution to be ratified by ordinance, or by ordinance, designate and/or create parking spaces on public streets which shall be designated as paid permit parking, which said spaces shall be marked off either in parallel or diagonal fashion. The fee for said designated on-street paid permit parking spaces shall be as set forth in § 256-58, Schedule XII: Permit Parking Rates (rates adopted for off-street facilities).

Parking meters shall be installed by Latrobe or its agents or designees in on-street parking zones and in off-street parking facilities as hereinabove described. Each parking meter shall comply with a description of the same as set forth in § 256-1, Definitions and word usage, definition of "parking meter." Such meters, after installation, shall be under the direct control of Latrobe or its designee, with the advice and recommendation of the Parking Authority of Latrobe pertaining to installation, location and rate structure for parking meters in the off-street parking system only.
Parking meter rates and length of time for on-street parking meters shall be established and amended, from time to time, by resolution of the Council of Latrobe. Parking meter rates and length of time for off-street parking meters shall be established and amended, from time to time, by resolution of the Council of Latrobe upon the recommendation of the Parking Authority of Latrobe, in accordance with the provisions of this Article and the agreement and lease and management agreement entered into between Latrobe and the Parking Authority. Notice thereof shall be given to the public, stating the length of time during which parking is permitted and conditions regulating the same, by either placing said notice on the parking meter or in the immediate vicinity of said parking facility. The parking meter rates for both the on-street parking system and off-street parking system as initially adopted are set forth in Schedule XI (§ 256-57).
Certain parking spaces in the off-street parking system may, upon recommendation of the Parking Authority of Latrobe, be established and amended by resolution of the Latrobe Council. Further, the rates and classifications for permit parking spaces shall also be established and amended by resolution of the Council of Latrobe upon the recommendation of the Parking Authority of Latrobe. The location of permit parking spaces, classification of the same and rate structure for each are set forth in Schedule XII (§ 256-58).
Any owner or operator of a vehicle causing the same to be parked in a metered parking space shall deposit in the appropriate parking meter adjacent thereto a coin or coins of the United States of America in the denomination required by such meter for a period of time up to the maximum allowable time permitted for parking by such meter.
The Council, through the Parking Authority of Latrobe, which is under a management agreement with Latrobe for the operation of the off-street parking facilities, shall designate a person or persons to collect the coins in the parking meters and fine boxes installed in the off-street parking facilities and to deliver the same to the office of the Secretary or to such other person or persons or depository as the Parking Authority of Latrobe under the management agreement may from time to time direct for the purpose of counting and depositing the same in the Parking Revenue Fund. Each collector of the coins from the parking meters and from the fine boxes shall furnish a bond to Latrobe for the faithful performance thereof in a sum of at least $1,000.
It shall be unlawful for any owner or operator of a vehicle and a violation of the provisions of this Article for said owner or operator to cause, allow or permit any vehicle registered in the name of or in possession of or operated by such owner or operator to be parked in a metered parking space for a period of time longer than that for which the coin or coins have been inserted into said meter. The occupation of a metered parking space in which a meter violation flag is shown in said meter shall be prima facie evidence of violation of this section entitled "Unlawful parking." The lapse of one hour from the time reported on the citation to the owner or operator or said motor vehicle shall be authorization for the issuance of subsequent illegal parking citations should such vehicle still be in violation of this section. Further, it shall be a violation of this section entitled "Unlawful parking" for a vehicle to be parked in any individual parking space other than in the manner hereinabove described in § 256-22.
A. 
It shall be the duty of the police officers of Latrobe or any other person designated by Latrobe to issue citations or tickets for illegal parking, in accordance with instructions given to them by Council, the Mayor or Chief of Police, to report the number of parking meter violations for both the on-street and off-street parking systems, reporting in each case:
(1) 
The number of each parking meter that indicates that the vehicle occupying the parking space for said meter is or has been parked in violation of any of the provisions of this article.
(2) 
The date and hour of such violation.
(3) 
The state license number of such vehicle.
(4) 
Any other facts the knowledge of which shall be necessary for a thorough understanding of the circumstances attending such violation.
B. 
There shall be attached to each vehicle standing in an individual parking space in violation of this article a notice to the owner or operator thereof that such vehicle has been parked in violation of a provision of this article. Each such owner or operator may, within 24 hours of the time that such notice of violation was placed upon such vehicle, discharge and satisfy the penalty for violation of any of the provisions of this article by placing the amount of fine indicated thereon in the envelope provided for that purpose with a notice of violation and delivering the same to the Police Department office in the Latrobe Municipal Building, by depositing the same in the closest courtesy box marked for that purpose or by depositing the same in the United States mail. Each owner or operator who fails to so discharge the penalty for violation within this twenty-four-hour period shall then pay at the Police Department office the current penalty for each and every violation as set forth in Schedule XIII (§ 256-59). Upon the failure of any owner or operator of a vehicle illegally parked in any metered parking facility or space to make the payments as aforesaid, said persons shall then be subject to the penalties as provided in § 256-30.
A. 
The Council of Latrobe shall establish and amend, from time to time, by resolution, the fines for violation of this article and as initially adopted herein shall be set forth on Schedule XIII (§ 256-59). Any owner or operator of any vehicle violating any provisions of this article or any person aiding, abetting or assisting in the violation thereof shall be issued a ticket or citation assessing a fine in accordance with the schedule set forth in Schedule XIII (§ 256-59).
B. 
There is hereby established a presumption that the individual who is the operator of a vehicle was so with the authority and permission of the owner, and, therefore, liability for payment of any fine or penalty shall be imputed to the owner. If any fine or penalty for parking violation is not paid to the City of Latrobe within seven days of the issuance, by either the owner or operator of the vehicle, then in that event the owner and/or operator shall commit a summary offense. The City of Latrobe may file a citation for nonpayment, which shall be a summary offense, with the appropriate District Justice against the owner and/or operator, or both. If the owner or operator, or both, are found guilty, either or both shall be jointly and severely subject to the parking fine set forth above and any additional fine for failure to pay the same and for costs of prosecution. Failure to pay any fine or cost levied by the District Justice within 10 days after conviction can result in incarceration of the owner and/or operator, or both, for a period not to exceed five days. Such fine and costs may also be collected through civil remedies as other charges or debts owing to the City of Latrobe may be collected. The District Justice may also impose such other remedial order as is within the jurisdiction of the District Justice in order to enforce the payment of fines and costs; and, the vehicle may be subject to the application of the Boot Ordinance as set forth in the Code of Ordinances for the City of Latrobe[1] for nonpayment of the fines and costs.

The fines for payment for violations deposited by the owner or operator of vehicles in the courtesy boxes placed and located at each of the off-street parking sites or deposited in the on-street courtesy boxes shall be collected by Latrobe, and said fines or payments for violations so collected shall be deposited by the Treasurer to the credit of Latrobe or in a special fund created by Latrobe under and pursuant to its agreement with the Parking Authority of Latrobe set forth in the agreement and lease dated August 1, 1956, which special fund shall be known as the "Parking Revenue Fund," or such other special fund appropriately designated in any current or future agreement controlling the leasing or operation of any off-street parking facility.
These regulations in this article supplement the other parking and traffic regulations of Latrobe. Any authority heretofore or hereafter exercised in Latrobe under any ordinance, rule or regulation restricting or prohibiting parking, independent of time limit, shall in no manner be affected by these regulations or any of the provisions hereof.
A. 
It shall be unlawful and a violation of this article for any owner or operator to cause, allow or permit a vehicle to be parked in the following areas within the on-street and off-street parking system:
(1) 
It shall be unlawful for any owner or operator of a vehicle that does not bear an appropriate handicap or disabled veteran license plate or placard to cause, allow or permit a vehicle to be parked in any space designated as "handicapped."
(2) 
It shall be unlawful for any owner or operator of a vehicle to cause, allow or permit said vehicle to be parked in a designated permit parking space without displaying an appropriate permit sticker in said vehicle for the type of designated permit parking designated for said space.
(3) 
It shall be unlawful for any owner or operator of a vehicle to cause, allow or permit said vehicle to be parked at any place in any facility of the off-street parking system that is not specifically designated as a metered or permitted parking space.
B. 
Any owner or operator who causes, allows or permits any vehicle to be parked in violation of this section, shall be issued a ticket or citation assessing a fine in accordance with the schedule set forth in Schedule XIII (§ 256-59).
C. 
Any operator or occupant of any vehicle entering and/or remaining in the downtown garage premises is hereby prohibited from:

(1) 
Smoking any form of tobacco product while outside his or her vehicle and standing or being seated on the floor area.
(2) 
Throwing, projecting, discharging or discarding butts, or other forms of tobacco residue, from any smoking product, including but not limited to cigarettes and/or cigars.
Certain sites in the off-street parking system set forth on in Schedule X (§ 256-56), being site Nos. 11, 12, 13 and 14, are situate upon private property of Latrobe Area Hospital, Inc., with said lots having been leased to the Latrobe Parking Authority and thereafter leased back to Latrobe Area Hospital, Inc. All provisions of this article relating to unlawful or illegal parking, specifically §§ 256-28, 256-30, 256-31, 256-32 and 256-33, shall be applicable to these sites. Further, the Council of Latrobe does hereby vest in the members of the security staff of Latrobe Area Hospital, Inc., those powers to monitor parking in said lots and issue appropriate tickets or citations for violation of any prohibition as set forth in this article relative to parking in the on-street or off-street parking system in the R-6 Hospital Zone or any R-1, R-2 or R-1A Zone adjacent to and abutting upon the R-6 Hospital Zone. Said tickets or violation shall have the same force and effect of law as if issued by a member of the Police Department of Latrobe or any other person designated by Latrobe Council to issue tickets and citations. The vesting of this power and authority in the members of the security staff of Latrobe Area Hospital, Inc., shall in no way, in fact or in law, deem said individuals to be employees of Latrobe.
