As specified under § 8-24 of the General Statutes of Connecticut, no municipal agency or legislative body shall locate, accept, abandon, widen, narrow or extend any street, bridge, parkway or other public way, locate, relocate, acquire land for, or abandon, sell or lease any airport, park, playground, school or other municipally owned property or public building, extend or locate any public housing project or redevelop, recondition or improve any specific area, or take action on any proposal involving the extent and location of public utilities and terminals, whether publicly or privately owned, for water, sewerage, light, power, transit and other purposes, until the proposal to take such action has been referred to the Planning and Zoning Commission for a report.
A complete application shall consist of a complete and comprehensive statement describing the proposed use and all improvements relating thereto and all required supporting information. Seven copies of the complete application shall be delivered to the Zoning Enforcement Officer for transmittal to the Commission at its next regularly scheduled meeting. The date of receipt of such application shall be deemed to be the earlier of the date of such next regularly scheduled meeting or the 35th day following the date it was delivered to the Zoning Enforcement Officer.
Each application shall be accompanied by the supporting information specified in §§ 500-151 and 500-152 of these regulations.
The Planning and Zoning Commission shall issue a report on the proposed municipal improvement within 35 days after the date of receipt of the application. The Commission shall, in deciding such application, consider and make appropriate findings relating to the standards specified in § 500-155 of these regulations. The failure of the Commission to report within 35 days after the date of receipt of the publication shall be taken as approval of the proposal. In the case of disapproval of the proposal by the Commission the reasons therefor shall be recorded and transmitted to the legislative body of the municipality. A proposal disapproved by the Commission shall be adopted by a municipality only after a majority vote of those present and voting in an Annual or Special Town Meeting.
