Pursuant to the Library Code of 1961 of the Commonwealth of Pennsylvania, P.L. 324 of June 14, 1961, Article IV, Section 401 et seq. (24 P.S. § 4401 et seq.), the Media - Upper Providence Free Library Association is hereby designated as the library facility and agency for the Borough of Media to provide public library service to the residents and taxpayers of the Borough of Media.
The proper officers of the Borough of Media are hereby authorized to enter into a contract with said Media - Upper Providence Free Library to effectuate the purposes hereof and of the aforesaid Act of Assembly,[1] which contract shall provide for and set forth:
A. 
The amount of an annual appropriation by Media Borough to said Free Library, to be set annually by the Council.
B. 
The availability of the library to the residents and taxpayers of the Borough of Media.
C. 
The annual filing and auditing of the accounts of the Treasurer of said library by the Borough of Media as in the case of other municipal expenditures.
D. 
The vesting in the Council of the Borough of Media of the right to appoint never less than two members of said Board of Directors or 1/5 of the total membership if two members comprise less than 1/5 of said total, as the Council of the Borough of Media in its sole discretion shall determine.
E. 
That the main library shall be maintained in Media Borough.
F. 
Such other provisions as are or may be required by said Act of Assembly or in conformance with its intent and purpose.

The Council of the Borough of Media shall determine annually in its budget an appropriation out of current revenues in an amount at least equal to the amount appropriated in 1965 but not more than an amount equal to 3 mills, to be paid to said Free Library Association for its support and maintenance. The Council shall nevertheless have the right to make no appropriation, provided that it submits the question of levying a special tax, as provided in the aforesaid Act of Assembly,[1] and gives notice of its intent to do so when it adopts the preceding annual budget and has submitted said question to the qualified electors in that year.

The Media Borough Council shall appoint from the residents of the Borough of Media at least two to serve as members of said Library Board of Directors; the Council may appoint, in its discretion, additional members up to a number not to exceed 1/5 of the total membership of said Board of Directors. Terms of office shall commence on January 1 and be for three years; the terms shall be staggered so that as nearly as possible 1/3 shall expire each year, and the Council shall fix the terms of the first appointees to conform hereto.
The Treasurer of said Free Library shall give a surety bond to the borough as provided by said Act of Assembly[1] and, as further provided by said Act, shall file his accounts and reports for audit annually.

No moneys shall initially be paid to said library unless or until said contract is signed and the bond given, and thereafter shall not be paid unless said bond is maintained and reports and accounts filed for audit as provided.
The aforesaid contract shall be for a term of three years and shall contain a provision for automatic renewal and shall be ratified by motion of the Council before it initially becomes effective.
