That certain documents, three copies of which are on file in the office of the Code Enforcement Officer and the Borough of Media, being marked and designated as the Plumbing Code, including Appendix Chapters, the 1995 International Plumbing Code published by the Building Officials and Code Administrators International and the International Conference of Building Officials, be and is hereby adopted as the code of the Borough of Media for regulating the design, construction, quality of materials, erections, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the Borough of Media, providing for the issuance of permits and collection, conditions and terms of such International Plumbing Code, 1995 Edition, published by the Building Officials and Code Administrators International, Inc., International Conference of Building Officials and the Southern Building Code Congress International, Inc., on file in the office of the Borough of Media are hereby referred to, adopted and made a part hereof as if fully set out in this chapter.
Ordinance Numbers 492, 496, 510, 521, 536, 548, 549, 553, 601, 673 and 825 of the Borough of Media are hereby repealed, and all other ordinances or parts of ordinances in conflict herewith.

Section 106.5.3 Insert: 75% in two places. (Refunds).
Section 108.4 Insert: Any person, partnership or corporation who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair plumbing work in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, upon being found liable therefore in a civil enforcement proceeding commenced by a municipality, pay a judgment of not more than $500, plus all court costs, including reasonable attorney fees incurred by a municipality as a result thereof.
Each day that a violation continues shall constitute a separate violation, unless the district justice determining that there has been a violation further determines that there was a good faith basis for the person, partnership or corporation violating the chapter to have believed that there was not such a violation, in which event there shall be deemed to have been only one such violation until the fifth day following the date of the determination of a violation by the district justice and thereafter each day that a violation continues shall constitute a separate violation. All judgments, costs and reasonable attorney fees collected for the violation of this chapter shall be paid over to the municipality.
Section 108.5 Insert: not less than [$500] nor more than [$1,000]." (Stop work orders).

Chapter 14, Referenced Standards. Insert: 1996 BOCA National Building Code and 1996 International Mechanical Code.
A. 
The term "Code Official" as stated throughout the BOCA Building and Plumbing Codes shall be defined as the Building Officer, and said officer shall be the Borough Secretary unless the Council, by motion, appoints another person to be said officer. It shall be said Building Officer's duty to enforce any provisions and regulations of the Media Building Code.
B. 
Building Inspector. In addition to the Building Officer, the Council may, by motion, appoint a Building Inspector. His duty shall be to enforce the provisions of this code, under and at the direction of the Building Officer.
C. 
Plumbing Inspector. In addition to the Building Officer, the Council may, by motion, appoint a Plumbing Inspector whose duty it shall be to enforce the Plumbing Code adopted hereby and any specific provisions of the BOCA National Plumbing Code, Ordinance No. 855, relating to plumbing, under and at the direction of the Building Officer.
D. 
Electrical inspection. Electrical inspection shall be done by a qualified underwriter electric and fire inspection enforcing agency. There shall be cut cards sent to the Borough of Media by the inspection agency.
A. 
The designations of the subsections herein provided of this chapter shall be the section designations of the aforementioned BOCA Plumbing Code, and are substantially related.
B. 
Reference to the codes and appendixes in or of the BOCA Plumbing Code shall, for the purposes hereof, be considered as part of the BOCA Plumbing Code and collectively referred to as a part thereof, but only as made applicable thereby or by this chapter.
C. 
As between the provisions of this chapter and the BOCA Building Code, the latter shall be the basic building code and be controlling except as to the portions changed or made inapplicable by this chapter. Wherein this chapter provides for procedures or regulations differing from those set forth in the BOCA Plumbing Code, the procedures or regulations of the BOCA Plumbing Code are rendered inapplicable; wherein there may be no ambiguity or conflict between the provisions of this chapter and the BOCA Plumbing Code. The provisions of this chapter shall apply; and wherein provisions of this chapter and those of the BOCA Plumbing Code create no conflict or ambiguity, the provisions of both shall apply and they shall be read together to establish one procedure or regulation.
The Zoning Law herein referred to shall be the Media Zoning Ordinance No. 823 in effect, and as amended or changed as of the date of any application for any permit hereunder and payment made therefor. Such parts of or sections of said ordinance, which also regulate in the scope of this chapter, are repealed hereby or, if adopted hereafter, are hereby made inapplicable; if an ambiguity or conflict arises between the terms of this chapter and such Zoning Ordinance, the terms, provisions and regulations of this chapter shall repeal and take precedence, unless said Zoning Ordinance specifically makes a conflicting section of it controlling over this chapter.[1]

A. 
Every person, firm or corporation engaged in the plumbing, drainage or any related business, doing or desiring to do or perform such business or work in the Borough of Media, shall first register his, its or their name with the Secretary of Borough of Media and present satisfactory proof that he, it or they are employed bona fide plumbers to do and perform their work. If said proof is found to be in fact satisfactory, according to the accepted standard of plumbing practice or as may be adopted as rules or regulations under this code, and upon payment of a fee of $50 to the Treasurer of the Borough of Media and a filing of a bond in the amount of $1,000 acceptable to the Borough of Media for the faithful compliance with the Plumbing Code and proof of worker's compensation insurance, the Secretary shall issue a certificate of registry, which shall be good for the calendar year in which issued. At the close of each calendar year, all certificates issued in that year shall become null and void.
B. 
Before any plumbing permit is issued, the applicant shall present a certificate of registration of the plumber or plumbing business engaged to do the work, together with a detailed plan of the work approved by a master plumber, showing all necessary and appurtenant connections and drainage. If the work involves a construction or reconstruction of the plumbing system, drainage or sewer system or any part thereof, the plan shall show the entire system with the location of all fixtures, traps, vents and vent pipes. This is in addition to Section P-111.5.1 et seq. of the BOCA Plumbing Code. The Building Officer or Plumbing Inspector may require such other or additional information as shall be necessary to adequately form a judgment of compliance with this chapter; and the applicant shall furnish such information. In addition, every application shall certify that the work will be done by or under the directions of a master plumber.
The Building Officer shall report all permits issued to the Council at its regular meetings. The Building Officer and Inspector shall have no power to issue permits for a new building or structure without the approval of Council. All applications for any permit shall be filed with the Borough's Secretary, who shall, after noting receipt of the same, forward them to the Building Officer or Inspector, as the case may be, for processing in accordance with the provisions hereof. No permit shall be valid unless signed by the borough's Secretary and the Building Officer and appropriate Inspector. A permit shall set forth certain stages of construction when the Building Officer and appropriate Inspector shall inspect and approve the work done to that stage. Until the Building Officer or Inspector gives that approval, any work beyond that stage shall be in violation of this chapter. The respective Inspector shall file reports as directed by the Building Officers.
The Building Officer, Building Inspector or Plumbing Inspector shall not hire or engage the services of any other person without the approval of Borough Council.
§ 223-11. Effect. That nothing in this chapter or in the Building Code hereby adopted shall be constructed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 223-2 of this chapter, nor shall any just or legal rights or remedy of any character be lost or impaired by this chapter.
